Legal Alert 📌 The ODPC in the case of Migguel Ventures Limited vs the Office of the Data Protection Commissioner and Nancy Mugo was found to have acted illegally when issuing a 14-day notice period to the Respondent to file a response. The Court ruled that the ODPC's 14-day notice period was arbitrary. A 21-day notice was required to provide the applicant a reasonable chance to state their case. The shortened timeline harmed the Applicant by limiting their right to be heard. Note that; ·Section 58(1) of the Data Protection Act: Empowers the Data Commissioner to issue an enforcement notice to an individual or organization failing to comply with the Act's provisions. ·Section 58(2) as read together with Regulation 11(1) of the Data Protection (Complaints Handling Procedure and Enforcement) Regulations, 2021: Guarantees a minimum 21-day response period for the recipient (respondent) of an enforcement notice. I recently presented at the Nigeria Data Protection Commission- NDPC's Draft Nigeria Data Protection Act - General Application Implementation Directive (NDP Act - GAID) Validation Workshop, held in Lagos, in partnership with Paradigm Initiative. NDP Act - GAID seeks to provide further directives and clarifications on the implementation of the Nigeria Data Protection Act, 2023. The draft NDP Act - GAID can be found on the Commission's website under the "Resources" tab. This workshop allowed stakeholders to discuss, examine, and share insights on the NDP Act - GAID. Stakeholders provided active feedback on the draft, raising questions and concerns, which are all crucial steps in the Commission's law-making process. My presentation focused on further directives and clarifications in relation to: - Principles of Data Processing - Lawful Bases of Data Processing - Data Subject Rights - Enforcement Mechanisms The Validation Workshop is a great initiative by the Commission to ensure the final NDP Act - GAID reflects the needs of all stakeholders and the data protection ecosystem. This workshop will also be held in other regions in the country, including Rivers State in the South, and the FCT Abuja, in the North. All interested stakeholders are encouraged to attend. Here are some key takeaways: * A comprehensive overview of the Nigeria Data Protection Act (NDPA) and other essential laws governing data management practices. * Insights into the roles and responsibilities of Data Controllers and Data Processors, and their approaches to data handling across different organizations. * Knowledge about individuals' data rights, including the right to access, rectify, and request deletion of their personal data. * Best practices for collecting only the necessary data and ensuring data processing is limited to essential purposes. * Fundamental strategies for safeguarding data against unauthorized access, breaches, and misuse. *The importance of transparency and accountability in organizational data practices to maintain trust with data subjects.
