Tanzania officially established the Personal Data Protection Commission (PDPC) on April 3, 2024, an event presided over by President Samia Suluhu. Among the important duties charged to the commission is monitoring data privacy laws and responding to individual complaints to guarantee the protection of people's right to privacy and personal information. The creation of this commission is essential to support the expansion of the digital economy and guarantee the safe management of data, both locally and globally. Organisations that gather and handle personal data will be required to carefully follow data protection regulations. As we know, advancements in technology have led to increased worries about the unauthorised collection, use, and processing of personal information. Despite these dangers, many online firms still heavily rely on personal data as a source of income. 📢 Tanzania: Understanding the Personal Data Protection Act (PDPA 2022) Section 26 of the Act emphasises the disclosure of personal data, prohibiting data controllers from disclosing personal data to any individual other than the data subject, except under specific circumstances outlined in Section 25. While this provision is intended to safeguard privacy, the exceptions in Section 25 raises significant concerns about the potential for unauthorised or unjustified data sharing. This can undermine the protection offered by Section 26, posing a risk to individuals' right to privacy guaranteed by Articles 13 and 16 of the Tanzanian constitution. While the Act is a step forward in regulating personal data use, stronger oversight mechanisms are necessary to ensure exceptions are not abused, protecting citizens from violations of their constitutional rights. The legal requirement to obtain approval from the Data Commissioner Office of the Data Protection Commissioner before transferring sensitive personal data outside Kenya remained where the data subjects approved the transfer of their information and where no complaint had been filed to the Data Commissioner. This matter arose in Petition E085 of 2023 Federation of Kenya Employers v Cabinet Secretary, Ministry of Foreign Affairs and International Relations & 4 others; whereby the case addressed whether the 4th and 5th respondents had breached the Data Protection Act by transferring sensitive personal data outside Kenya without proper approval from the Data Commissioner. The court found that the High Court Practice and Procedure Rules were outdated and inadequate for enforcing foreign orders and protecting sensitive data. It ruled that significant updates to these rules were necessary.  The court also made a declaration that any transfer of data from Kenya for use in a foreign jurisdiction can only be undertaken, inter alia, within the framework of section 48 of the Data Protection Act. #DataProtection #DataProtectionKE #DataTransfers #InternationalDataTransfers

This week I represented the Nigeria Data Protection Commission- NDPC at the House of Representatives Committee on Commerce public hearing on a Bill to establish an Incorporated Corporate Data Management Commission. At the Hearing, I emphasised the importance of: a. Recognising the Nigeria Data Protection Commission as the apex regulator for personal data within corporate data, in the Bill. b. Reinforcing the Nigeria Data Protection Act, 2023, and its standards for handling personal data, in the Bill. c. Strengthening existing regulatory frameworks and agencies to achieve the Bill's objectives. d. Establishing an inter-agency committee to review the Bill to ensure seamless and secure corporate data transfer. #datagovernance #ndpc #dataprotection

South Africa's Information Regulator issued its first enforcement notice to FR Ram Consulting, a training institution, for repeatedly sending marketing emails to a user who had unsubscribed from the mailing list multiple times. The regulator has ordered FR Ram Consulting: ✅to stop sending unsolicited direct marketing messages by means of electronic communication to any data subject who has not consented; ✅to ensure that the first communication sent to data subjects is one in which FT Rams requests their consent and must approach such data subjects only to obtain consent; ✅to ensure that they only send such a message to a data subject who had not previously withheld their consent; and ✅to compile and maintain a database of all data subjects who had previously withheld or did not consent to receiving unsolicited direct marketing messages and submit a design of such database to the regulator.
