The Intellectual Property (IP) Committee and the Sports, Entertainment and Media (SEM) Committee, both of the Nigeria Bar Association- Section on Business Law (NBA-SBL), have partnered to organize a roundtable webinar in celebration of World IP Day 2024, titled: “IP meets Sports: Achieving the Sustainable Development Goals (SDGs) through Innovation and Creativity in Sports”. Our Partner, Tolu Olaloye, Vice Chairperson of the Sport, Entertainment & Media Committee, will also speak there. This year's theme for the celebration is “IP and the SDGs: Building our common future with innovation and creativity,” and we appreciate the value that IP rights will continue to play in emerging developments in creative and innovative industries, where sports continue to play a pivotal role globally. Post- webinar; This was one of those webinars that time went by so quickly, it seemed ridiculous. 😳 The Speakers were fantastic & I will share some takeaways/call to action: 📍1.Mass participation in sports is where the money is.(on how Sports can help in the achievement of some of the SDGs) - Madam Nkechi Obi. 📍2. Commercialization of sports in Nigeria with the aid of collaborations & partnerships, we can achieve some of these SDGs - Victoria. 📍3.We are not lacking in laws, policies or regulations. What we need is the political will to drive the growth that has become over-due. We also need a dispute resolution mechanism that is specific to the Sector in order to gain investor confidence - Mr. Chijioke Okoli SAN. 📍4. The ability to harness the economic potential in sports through infrastructure & investment can help achieve some of the SDGs( practical examples, UK Cycling strategy, webber engineering, i-fitness, & NUGA games to drive home the point) - Adedammy Adedotun. This is just less than the summary but the point has been made. SDG 1. No poverty 2. Zero hunger 3. Good health & wellbeing 5. Gender Equality 8. ⚫🟡🔴 Australia's First Indigenous Knowledge (IK) Panel for Intellectual Property ⚫🟡🔴 IP Australia has announced that applications are currently open for Aboriginal and Torres Strait Islander peoples to become panel members to protect IK in Australia’s intellectual property system. The panel, in its pilot stage, will consist of three Aboriginal and Torres Strait Islander peoples who have relevant expertise and experience in areas including IP rights and legislation, Aboriginal and Torres Strait Islander culture and knowledge, community engagement and business/legal matters. In comparison, across the ditch, New Zealand has established the Māori Trade Marks Advisory Committee (MTMAC) which provides advice to IPONZ on whether or not elements of a trade mark application contain material that is likely to be offensive to Māori. No commentary, as of yet, on whether Australia’s IK Panel will be enacted in the Trade Marks Act 1995 (Cth), which is the case for the MTMAC in New Zealand’s equivalent Trade Marks Act 2002 (NZ). However, a major pitfall of the advisory system relies on the presumption that an Examiner is able to first recognise that a trade mark contains IK and/or material before then seeking advice from the committee. It will be interesting to see how, given the diversity of Indigenous culture in Australia, that this problem will be remedied. On 30 May 2024, the Ministry of Industry, Trade and Investment inaugurated an inter-ministerial committee to review Nigeria’s draft IP policy and strategy. This initiative aims to enhance the draft National IP Policy and Strategy initially validated in September 2022. The committee’s responsibilities include updating the draft policy for submission to the Federal Executive Council and revising national IP legislation to align with international standards. This development marks a significant stride towards modernising Nigeria’s IP framework, as the current draft contains a myriad of strategic policy moves poised to reshape the country’s IP landscape. This update delves into the focus of the policy based on the current draft and discusses the anticipated developments should this draft policy be approved by the executive council and implemented. Nigeria's 🇳🇬 creative industry is booming globally. The intention now is to impact regionally, riding on the back of The African Continental Free Trade Area. Just look at him. Such confidence in damask dungarees, beads and aso oke cap. Totally contemporary African look influenced by indigenous fashion for young people. Look at the stares and the smiles. Feels like Nigeria colonising the world 🌎 through creativity. Something happened to me yesterday after the Global Creative Legal Summit. I wanted to eat amala from Labule. Someone else's food. If you know you know. I walked to the door and met a pleasant young man who stood back for me to go in. I later met him and a friend at the till. His friend said I know you ma, are you the IP Prof. I said yes I am. I asked if he is or was a Babcock University student and he said no, that he recognised me from LinkedIn. He follows me and likes my posts. THE POSITIVE POWER OF LINKEDIN. Posting on LinkedIn is not something done in minutes, it takes a bit of time looking for appropriate videos. I need these videos to attract a particular audience. I was thinking of stopping but now I won't. My target is to provide information on IP in Nigeria 🇳🇬 - Africa and to make the posts interesting for everyone, with the intention of making IP attractive to the younger generation as much as possible. To lure them into the world of creativity and IP. To make them understand the opportunities and benefits of IP in Nigeria - Africa. To know creativity which is dependent on the mind can make them money. To encourage young IP lawyers and academics to be more involved in intellectual property rights issues. Sadly, I did not ask for their names but this post is dedicated to them. Thank you for the positive feedback.

Nigeria: IP Policy and Strategy An Inter-Ministerial Steering Committee was recently inaugurated to review the Intellectual Property Policy and Strategy Draft for Nigeria. The committee’s task is to ensure that it aligns with global best practices and addresses Nigeria’s unique needs. The thinking is that the review will significantly impact IP policy in Nigeria. For example, it will: 1. lead to the enactment and amendments of IP laws that align with the provisions of the IP Policy 2. simplify IP registration and improve enforcement 3. project Nigeria as an attractive destination for innovation and investment 4. encourage innovation and creativity among citizens #SpoorandFisher #IP #IntellectualProperty #Africa #Nigeria
