Section 2(a) of the Lanham Act bars federal registration of trademarks that are deemed as “scandalous” or “immoral” by the United States Patent and Trademark Office. . The legislative purpose of this prohibition is unclear and the law is fraught with problems, including vagueness, arbitrary enforcement and constitutional implications. In this paper I review the history of prohibitions against registration of such marks, the standards applied by courts, and the legal problems inherent in enforcement of Section 2(a). I advance a proposal that instead of barring these marks altogether, that the federal government should provide them with thin protection in order to mitigate the current problems with Section 2(a). I propose a basic framework for the requirements of registering “controversial” marks and the protections that would be afforded to those marks.

During ILTACON, I engaged in an interesting experiment with the vendors I met. Without prompting discussions about AI, I wanted to see how quickly it would come up naturally. Here are some metrics for reference, calculated using Excel (since AI and math aren't the best of friends yet): Average time for vendors to mention AI: 2 minutes and 37 seconds. Shortest time to mention AI: Approximately 30 seconds (since I couldn't start timing immediately). Longest time for vendors to mention AI: 19 minutes and 33 seconds. Interestingly, some vendors didn't mention AI at all, which makes sense if it's not part of their product line. If we consider the booths with AI prominently displayed on their banners, it would be simpler to count the ones that didn't feature AI. Day two wrapped up with a continued buzz around AI, but with a sharper focus on Microsoft Teams. Here are some insights and questions that emerged: Teams Management and Security: What are the prevailing strategies, and how do ethical screens fit into the picture? Collaboration in Teams: Should partners collaborate within a team or channels? Each approach has its drawbacks. Coexistence of Copilot, Teams, and DMS: How do they function together in the same ecosystem? Teams Sprawl: There's no clear path to halt the sprawl, a concern for IT teams. Teams with External Members: This adds complexity and might be best managed by creating separate teams, which ironically adds more complexity by solving one problem. Message Retention: Some firms advocate for short message retention periods of 7 to 10 days. While Teams is more established than newer products like Copilot, it still lacks a clear success path for legal applications, despite being further along the maturity curve than the Microsoft Office Suite. According to data provided by Epiq AACER, the 3,016 total commercial chapter 11 bankruptcies filed during the first 6 months of 2024 represented a 34 percent increase in total filings during the same period in 2023. “Commercial filing trends continue to show strong double digit percentage increases in year-over-year filings, while individual filings increased at a much lower rate compared to commercial filings in the first half of 2024,” said Michael Hunter, Vice President of Epiq AACER.
