    Section 2(a) of the Lanham Act bars federal registration of trademarks that are deemed as “scandalous” or “immoral” by the United States Patent and Trademark Office. . The legislative purpose of this prohibition is unclear and the law is fraught with problems, including vagueness, arbitrary enforcement and constitutional implications. In this paper I review the history of prohibitions against registration of such marks, the standards applied by courts, and the legal problems inherent in enforcement of Section 2(a). I advance a proposal that instead of barring these marks altogether, that the federal government should provide them with thin protection in order to mitigate the current problems with Section 2(a). I propose a basic framework for the requirements of registering “controversial” marks and the protections that would be afforded to those marks.
