Welcome to the CalPay website as developed by CAL Bank Limited. By using CalPay YOU AGREE
TO BE BOUND BY ITS CONDITIONS OF USE (explained below), Privacy Policy and all disclaimers
and terms and conditions that appear elsewhere on the CalPay website.
References to “the Merchant” refers to the institution’s setup on the CalPay solution to accept
payments.
CAL Bank reserves the right to make changes to the CalPay website and its terms and Conditions
of Use at any time without advance notice. Each time you use the CalPay website, you should
visit and review the Terms and Conditions of Use, that apply to your transactions and use of the
site.
By using the CalPay website, you expressly agree that use of the CalPay website is at your sole
risk. The CalPay website is provided on an "as is" and "as available" basis. Neither the Bank, nor
any of its associates, including but not limited to its directors, employees, agents, designers,
contractors, merchants (collectively, "Associates") warrant that use of the CalPay website will be
uninterrupted or error-free. Under no circumstances shall the Bank or its Associates be liable for
any direct, indirect, incidental, special or consequential damages that result from your use of or
inability to use the CalPay website, including but not limited to your reliance, on any information
obtained from the CalPay website that results in mistakes, omissions, interruptions, deletion or
corruption of files, viruses, delays in operation or transmission, or any failure of performance.
The foregoing limitation shall apply in any action, whether in contract, tort or any other claim,
even if an authorized representative of the Bank has been advised of or should have knowledge
of the possibility of such damages. You hereby acknowledge that this paragraph shall apply to all
content, merchandise and services available through the CalPay website.
Pricing Policy
The Bank may charge a convenience fee for certain services. Other services may be offered at
face value with no additional charge from the Bank. All convenience fees are subject to change.
Paying for Your Order
CalPay accepts multiple payment options. Payment options include but are not limited to Visa®,
MasterCard®, MTN Mobile Money® and CalPay wallet. Your credit/debit/prepaid cards and or
mobile money accounts are generally charged at the time you initiate an order.
After you place an order using our shopping cart, we will validate the information you give us, by
verifying your method of payment. We reserve the right to reject any order you place with us,
and/or to limit quantities on any order, without giving any reason. If we reject your order, we will
notify you on the website or via the e-mail address or phone number provided in your account.
Delivery of any such notification shall depend on the availability of the service provided by the
third-party e-mail or network providers. Your source of payment will not be charged if we reject
an order and will only be charged by the appropriate amount if we limit an order. In the event
where you are charged for a rejected order, the charge shall be reversed.
Settlement of Transactions
In the situation where the goods or service paid for is not received (After estimated delivery time
published by the merchant) or does not meet the standards published by the merchant, you are
required to lodge a complaint using the compliant section of the solution. This should be done
within 48 hours after date of expected delivery goods or service.
All funds will be settled to the merchant if no complaint is received during the above stated
period.
Refund Policy
All sales made through the CalPay website are subject to the Merchant's refund policy.
Termination of Use
CalPay may, in its sole discretion, terminate your account or your use of the CalPay website at
any time. You are personally liable for any orders that you place or charges that you incur prior
to termination. CalPay reserves the right to change, suspend or discontinue all or any aspects of
the CalPay solution or website at any time without prior notice.
Privacy and Data Protection
While using our Service, we may ask you to provide us with certain personally identifiable
information that can be used to contact or identify you ("Personal Data"). Personally identifiable
information may include, but is not limited to:

- First name and last name
- Phone number
- Address, Region, ZIP/Postal code, City
- Cookies and Usage Data
Such information if we collect, will be used for the purposes of providing services to you and
improving on our service provision to you.
Usage Data
We may also collect information on how the Service is accessed and used ("Usage Data"). This
