It was an honor to join Karl Susman on Insurance Hour and discuss several issues affecting the surplus lines marketplace. This conversation got me thinking about the California Department of Insurance’s List of Approved Surplus Lines Insurers (LASLI) and an often-overlooked service that The Surplus Line Association of California provides: full solvency reviews of approved insurance carriers. To protect California insurance consumers, we conduct a thorough financial analysis of approved surplus lines insurers that write business in the state to confirm they are reputable, solvent, meet capital requirements and can fulfill their obligations in the event of a claim. These reviews not just help maintain the financial stability of surplus lines insurers, they safeguard our market from insolvency crises. The LASLI is not a formality. Insurers who wish to be on this list must undergo a thorough vetting process conducted by our organization. This includes proving financial stability, management experience and expertise in their insurance specialty. Brokers and consumers alike can check if an insurer is on the LASLI via our website or the CDI website. California's Little Hoover Commission held a series of hearings with experts and recently issued a report on improving the California insurance market. Several of the commission's recommendations echoed the Sustainable Insurance Strategy currently being implemented by the California Department of Insurance, but they also recommended establishment of a WUI Data Commons (pp 27-28) and referenced groundwork laid by Milliman and Insurance Institute for Business & Home Safety - IBHS. As an update, we are mostly through a second phase of development for the data commons, under the guidance of California Fire Chiefs Association & funded by the Gordon and Betty Moore Foundation. Once it gets wrapped up in the next 1-2 months, we're hoping to move to Phase 3 build stage. Flood insurance claims in California soared nearly 211% in 2023, reaching an all-time high of more than $59.3 million, according to National Flood Insurance Plan (NFIP) data. And despite severe flooding and storms that caused nearly $5 billion in damages last year, the number of Californians with NFIP policies decreased in 2023. #wrightflood #weareflood

𝗨𝗽𝗱𝗮𝘁𝗲𝘀 𝗼𝗻 𝘁𝗵𝗲 𝗖𝗮𝗹𝗶𝗳𝗼𝗿𝗻𝗶𝗮 𝗙𝗔𝗜𝗥 𝗣𝗹𝗮𝗻 Many consumers have been struggling to place their property coverage and have had to turn to the California FAIR plan, the state's "insurer of last resort". This has resulted in heavy insurance premiums with very limited coverage that may not meet current standards. Insurance Commissioner Ricardo Lara has announced a significant agreement to modernize the California FAIR Plan as part of an ongoing effort to stabilize the insurance market and address the property insurance crisis, where we continue to see traditional carriers opting to leave California and often leaving the FAIR plan as the only available option. This modernization is a key element of Lara’s Sustainable Insurance Strategy, the largest reform since 1988's Proposition 103. 𝗠𝗮𝗷𝗼𝗿 𝗰𝗵𝗮𝗻𝗴𝗲𝘀: 1. 𝗘𝘅𝗽𝗮𝗻𝗱𝗲𝗱 𝗖𝗼𝘃𝗲𝗿𝗮𝗴𝗲: • New high-value commercial coverage option with limits up to $20 million per building. • Higher limits for residential policies to meet today’s property values and coverage needs. 2. 𝗙𝗶𝗻𝗮𝗻𝗰𝗶𝗮𝗹 𝗦𝘁𝗮𝗯𝗶𝗹𝗶𝘁𝘆: • A new financial formula to protect policyholders in extreme loss scenarios, ensuring long-term security. 3. 𝗜𝗺𝗽𝗿𝗼𝘃𝗲𝗱 𝗧𝗿𝗮𝗻𝘀𝗽𝗮𝗿𝗲𝗻𝗰𝘆: • Increased public reporting on FAIR Plan activities and customer service metrics. 𝗪𝗵𝗼 𝗱𝗼𝗲𝘀 𝘁𝗵𝗶𝘀 𝗶𝗺𝗽𝗮𝗰𝘁? • Consumers and Businesses: This initiative ensures a reliable safety net for those who cannot find insurance coverage in traditional markets. • Homeowners Associations and Builders: More robust coverage options and financial safeguards mean better protection and peace of mind. • Agricultural Sector: Enhanced coverage limits provide much-needed security for farms affected by wildfires and other risks. The California property insurance crisis is complex. 😣 But some things are not complex. 🤨 When a "consumer advocacy" organization proudly boasts that their efforts have reduced property insurance rate filing approvals by 35%,📉 and carriers subsequently experience surplus reductions in the billions, 💸 what do you expect the result to be? When insurers are actually required by law to foot the bill for the "advocacy" against their own rate filings, what's the result? 🤯 When California's largest property insurer has lost billions of surplus, gets downgraded by AM Best, and has their 28% rate increase filing challenged and delayed in the interest of "consumer advocacy", how do you think they'll respond? The ultimate result of this "advocacy" is a tidal wave of insurers exiting the state, and tens of thousands of consumers and businesses left with 200%+ rate increases with the FAIR plan, if they're able to secure coverage at all. 😑 Have we redefined consumer advocacy? This article from CalMatters on the Global Sustainable Insurance Summit further highlights the market need to leverage catastrophe models for both ratemaking and pre-bind underwriting analytics. “When Lara asked Farmers Insurance CEO Raul Vargas what it would take to get insurers to start writing policies in California again after they stopped or delayed new business, Vargas pointed to one of the regulations Lara unveiled recently: allowing insurers to use catastrophe modeling when setting their rates. The California Earthquake Authority is making significant changes to earthquake insurance policies, including reducing personal property coverage from $200,000 to $25,000 and increasing minimum deductibles for older homes or those worth over $1 million, due to high reinsurance costs and inflation.
