There are expected to be big changes at the SEC under a second Trump administration. First, President Trump is expected to immediately replace Commissioner Gensler. That will start a cavalcade of pending rules and regulations that will be immediately put onto the back burners, unlikely ever to be revitalized. Additionally, there will be a significant decrease in the number of enforcement actions undertaken by SEC lawyers attempting to enforce rules and regulations already on the books. Moreover, the SEC will take a much more friendly tone toward the crypto industry

So many fascinating points in our lead article last night on Trump SEC pick Paul Atkins (led by our veteran SEC reporter Rob Schmidt): - His agenda is as ambitious as Gensler’s – in mirror image. Regulations repealed, rather than piled on. Crypto welcomed, not sued. Enforcement, in particular, reined in. - Atkins’ return would put him in a majority with two proteges and former aides: Hester Peirce and Mark Uyeda. The opportunity to work with them was a big reason Atkins agreed to return to gov’t/ Both are likely to get big portfolios, w/Peirce leading on crypto. - Atkins has a rocky history w/staff. Enforcement lawyers gave him the nickname “Commissioner No” because of his propensity to vote against their cases. “During my 31 years at the SEC, he was the most hated commissioner I can remember”- John Britt, a retired enforcement attorney. - Atkins will move fast. Top priorities: Unwinding litigation, rescinding guidance including SAB 121 and a legal bulletin that gives weight to the “broad societal impact” of shareholder proposals, sources say. - Streamlining the SEC too. Atkins has offered numerous ideas, including re-organizing the examinations division, setting up an advisory committee to review the enforcement unit, folding the PCAOB into the commission and drastically paring back Finra.
