At VICI86 we talk a lot about the cost of inaction. This is a great example - "headless" data companies (all credit to Neil Sweeney for that term) don't have a consumer facing interface. How can they manage consent effectively? Your 2024 & beyond data strategy needs to consider the risk of not knowing how the data you're using/buying is collected. ESPECIALLY if it's Sensitive Personal Information (SPI) data. That's a very wide range of data elements. States are increasingly enacting privacy legislation that can really hurt organizations that don't have full transparency into how data they use is collected. This could be incredibly expensive, not to mention the PR nightmare that comes with being named and/or convicted in one of these lawsuits. Make no mistake, there will be a LOT more of these law suits coming. These laws vary enough by state to make organizations of all sizes easy targets for AG's across the country. There will be a daisy chain of suits once a single org is identified as well. Your data strategy needs to be continually evaluated & updated to ensure privacy compliance. Find the best partners in the marketplace that provide the transparency needed to stay compliant. Always think of the customer/consumer first.
I coined the term (or at least I think I did.. 🤷♂️ ) of 'headless' data companies a number of years ago. What is this? A headless data company is a data company with no consumer front end or UX. Think data brokers and large data management platforms. The AdTech industry has been dominated by these firms that amalgamate data with no inclusion or knowledge by the consumer. Their ability to manage opt-in and opt-out is zero. They have no way to communicate with consumers whose data they hold, which puts them on a collision course with privacy regulators who require specific data verticals to have 'consent.' If you are a 'headless' data company, it's inevitable that you will likely 1. be sued (you are an easy target for AGs who are looking to protect consumers) 2. be hacked (too many profiles in one centralized spot), 3. Fined (by privacy regulators). It's increasingly unlikely that you can operate as a 'headless' data company in '24 and beyond. Reklaim
