Tenders for Single Stage Two part tendering through e-tendering process are invited on behalf of DURGAPUR
STEEL THERMAL POWER STATION, Damodar Valley Corporation, for the work, “Annual Rate Contract and
support service for Milling System (Coal Mills, Coal Feeders and their auxiliary equipment & Gates, Ducts,
Dampers, Pulverized Fuel Piping etc.) of Unit # 1 & 2 of DSTPS, DVC, Andal”.

 Bidders must positively complete online e-tendering procedure at www.tenderwizard.com/DVC. They shall
have to submit their complete Techno-Commercial Document and Price Bid Document only online in
the website.

 On due date of tender opening, the Techno-Commercial Bid shall be opened online first.

 The Price-Bid of Techno-Commercially qualified bidders shall be opened online at a date which shall be
notified later on at www.tenderwizard.com/DVC. Bidders can view the Price Bid opening date by logging in
to the website.

 Offers should invariably be kept open for acceptance for 180 days from the date of opening of the
tenders.

E-TENDERING
1. This tender is being processed through e-tendering system. For viewing detailed NIT, downloading of tender
documents and participating in Electronic Tenders, bidders should visit www.tenderwizard.com/DVC.
2. For participating in e-tendering process, the contractor shall have to get themselves registered to get user ID,
Password and digital signature. This will enable them to access the web site www.tenderwizard.com/DVC. and
download/participate in e-tender.
3. The blank tender documents can be downloaded from and duly filled document can be uploaded on website
www.tenderwizward.com/DVC only.

1. Estimated Cost: Rs. 2,00,04,663/- (Rupees Two Crore four Thousand six Hundred sixty
three ) only
2. Earnest Money (EMD): Rs. 4,00,093/- (Rupee Four Lac ninety three) only.
3. Cost of Tender: Rs. 3000/-(Rupees Three Thousand) only.
Papers/ Documents

Submission of Cost of Tender Document: Cost of tender document which is Rs 3000.00 (Rupees Three
Thousand) only shall be paid in the form of DD only in favour of “DVC, DSTPS, Andal” or “Damodar Valley
Corporation, DSTPS” drawn on United Bank of India or Bank of India or Union Bank of India payable at
Andal Branch. The Bidder shall also have to submit the cost of tender documents in hard Copy—(The bidder
shall scan the Demand Draft and upload the same in the prescribed form in the jpeg format in addition to

sending the original Demand Draft before the date and time of openings of the bids) in a sealed envelope super
scribing on it Cost of Tender Document against the “NIT No., date of opening and the Name of work” in the
office of the Superintending Engineer (Tech), DSTPS, DVC on or before 12/05/2014 (up to 15:00 Hrs. IST)
failing which the tender will be rejected.

Industries registered with NSIC shall be exempted from paying cost of tender document subject to production of
the documentary evidence like valid Registration certificate from appropriate Govt. Authority giving details such
as validity stores etc. Attested photocopy of Such documentary evidence shall have to be submitted in a sealed
envelope super scribing on it “NSIC CERTIFICATE” against the “NIT No., date of opening and the Name of
work” in the office of the Superintending Engineer (Tech), DSTPS, DVC on or before 12/05/2014 (up to 15:00
Hrs. IST) failing which the tender will be rejected.

Submission of EMD (Earnest Money Deposit): Earnest money which is Rs. 4,00,,093/- (Rupee Four Lac ninety
three) only paid in any of the following form:

a. Pay order or Demand Draft in favour of “DVC, DSTPS, Andal” or “Damodar Valley Corporation, DSTPS”
drawn on United Bank of India or Bank of India or Union Bank of India payable at Andal Branch.
b. Bank Guarantee from Nationalized Bank/Scheduled Bank/Foreign Banks, irrevocable and operative till the
validity of the offer as per standard Proforma.
c. Fixed deposit receipt issued by Nationalized Bank duly endorsed in favour of DVC.
d. DVC bonds duly endorsed in favour of DVC.
e. Post office National Savings Certificate, having face value equal to the EMD value and duly endorsed in favour
of DVC.

 The offer accompanied by B.G against EMD will only be considered valid on acceptance of the Bank
guarantee. The offer not accompanied by specified EMD in proper form as defined above shall not be
considered as valid tender for opening.
 Earnest Money will only be refunded to the unsuccessful tenderer after finalization of tender and no interest
will be paid for the same.
 The amount of Earnest Money will be refunded to the successful tenderer, after acceptance of Security Deposit-
cum- Performance Bank Guarantee.
 Small Scale Industries registered with NSIC and seeking exemption under NSIC shall be exempted from
the payment of Earnest Money (up to their monetary limit). SSI Units seeking such exemption must
upload scanned copies of valid Registration certificate from appropriate Govt. authority giving details
such as Validity, Stores etc. in the website www.tenderwizard.com/DVC and also submit the hard copy
of the uploaded documents in a separate envelope super scribing “NSIC CERTIFICATE” to the office of
SE (Technical), DSTPS, DVC before the date and time set for bid submission (uploading).
 The above instruments i.e. “BID SECURITY/EMD” or “NSIC CERTIFICATE” (as applicable) shall have to
be submitted in hard copy- (The bidder shall scan the EMD in any of the above form or NSIC
CERTIFICATE (as applicable) and upload the same in the prescribed form in the jpeg. format in addition to
sending the original one before the date and time of openings of the bids) in a sealed envelope super scribing
on it, the NIT No. and due date of opening and should reach SE (Tech.), DSTPS,DVC office before due date
& Time of bid opening otherwise their techno commercial Bid will not be opened .
DVC authorities will not take any responsibility to accept any documents which are received in this office late i.e.
after 15:00 Hrs. of 12/05/2014 due to postal delay

INSTRUCTIONS TO BIDDERS (ITB)

1. E-TENDERING CLAUSES
a. The Bidders must visit the website www.tenderwizard.com/DVC to download the notification/ blank
tender documents relating to CE/DSTPS/T/1607/ARC Coal Mill/Tender/412, Dated: 31/03/2014
b. The detailed NIT includes:
i. Qualifying Requirement (Annexure-I), Scope of Work (Annexure-II), BOQ (Annexure-II
B),Technical Terms and Conditions (Annexure-III), Commercial Terms and Conditions & Other
Terms and Conditions (Annexure-IV)
ii. Techno-Commercial Bid Document (Annexure-A) Techno-Commercial Deviation Schedule
(Annexure-C), Cost of Withdrawal of Deviations (Annexure-D) and Price Bid document
(Annexure-B).
iii. Proforma for BG in lieu of EMD (Annexure-E) & Checklist for BG (Annexure-F).
These documents should be downloaded from the website.

c. Bidders must positively complete online e-tendering procedure at www.tenderwizard.com/DVC. They
shall have to submit their complete Techno-Commercial Document and Price Bid Document online in the
website only.
d. Authorized representative of the firms may attend the opening, if so desired. If the due date of opening is
declared a holiday by DVC then opening will be done at the same specified time on next working day.
Further in case of any change of venue, date & time, the same will be intimated / uploaded on website
separately.
e. The Bidders must fill all the details in the Price-bid document and Techno-Commercial Document after
going through the NIT. The specific instructions of filling in the details are mentioned in the documents
itself. Bidders are requested to study the instructions carefully before filling the documents.
f. The Bidder must mention whether he has taken any Techno-Commercial Deviation or not in
Annexure-A. The deviations, if any, must be mentioned clearly in Annexure-C.
g. In case of any deviations, the Bidder has to fill in the cost of withdrawal of deviations in Annexure-
D (To be submitted online along with Price bid Annexure-B)
h. After filling all the documents, the Bidder has to upload those documents in the website again. The
documents which the Bidder has to fill after downloading are marked in red colour. As soon as he uploads
those documents after filling the details, their colour is changed to black.
i. If the Bidder uploads the tender documents without filling them completely as per the instructions given
in them, DVC reserves the right to reject the bid.
j. The bidder has the option for sending the Cost of bid document, Bid Security / EMD, NSIC Certificate(if
any required) , by registered post / courier or submitting the same in person, so as to ensure that the same
are received in the specified office of the owner by the date and time indicated in this NIT. The owner,
however, shall not take any responsibility, whatsoever for any postal / courier delay.
k. Self certified scanned copies of all relevant documents e.g. Recent WO copies, Trade License, latest
STRC/VATRC as the case may be, EPF Registration certificate, ESI Registration Certificate, Valid
Labour License etc. wherever needed, must be uploaded in the website in the “Document Library”.
However DVC reserves the right to call for original documents, failing which, the offer is liable for
rejection.
l. Addendum/Corrigendum/modification/extension, if any, shall be published in the website only.
m. DVC shall not be responsible in any way for any delay/difficulties/inaccessibility of the downloading
facility from the website for any reason whatsoever.
n. For any information regarding filling of the tender documents, Bidders are requested to download the
Vendor’s Manual from www.tenderwizard.com/DVC. They may also mail [email protected] or

2. Before filling the offers, bidders are requested to go through the general conditions of Contract, DVC in order
to familiarize with DVC's commercial terms & conditions, Cost Compensations for deviations and bid
evaluation procedure.
3. The Bidder is also advised to visit and examine the site and its surroundings and will obtain on its own
responsibility all information that may be necessary for preparing the bid and entering into a contract for the
subject job. The costs of visiting the site shall be at the Bidder's own expense.
4. DVC reserves the right not to accept the lowest rate quoted by a Tenderer and reject any or all the tenders
without assigning any reason thereof.
5. On receipt of formal Work Order in duplicate, one copy shall be returned to the work order issuing authority
within 15 days duly acknowledged with signature, seal of the firm with date as a mark of acceptance of the
contract.
6. Settlement of disputes and Arbitration: It will be guided as per Clause No. 48 of GCC available in

7. The bidders who are found to be indulging in changing/adding or deleting the contents of tender documents will
be liable to face necessary action as deemed fit including banning, suspension of business dealings etc.
8. In case of any discrepancies found between the downloaded tender documents from the website and the master
copy available in the office of the Tender Inviting Authority, the latter shall prevail and will be binding on the
bidder(s). No claim/appeal on this account will be entertained or given cognizance. Bidders will be solely
responsible for the correctness/genuineness of the downloaded tender documents from the website, If the offer
submitted through the downloaded tender documents which are incomplete or with changed contents, the offer
will summarily be rejected.

LOCATION OF THE PLANT

Location of DSTPS Site

DSTPS Site is at the side of NH-2 near Durgapur in the District of


Burdwan, W.B. and is 18 km (approx) by Road from Durgapur Railway
Station of Eastern Railway and 4.5 km by Road from Andal Railway
Station of Eastern Railway.

Annexure-I
QUALIFYING REQUIREMENT

A. The bidders shall have the following working experience of:

Successfully executed mechanical maintenance/ overhauling job of Milling System (XRP Type) on
AMC/ARC basis in power utilities like DVC/NTPC/SEBs/ Govt./ PSU/other reputed power
organizations having each unit capacity not less than 110 MW for a period of continuous 1 (one) year
or more during last 7 years ending last day of month previous to the one in which offers
are invited.

B. The bidder’s experience of having completed similar jobs during last 07 years ending last day
of month previous to the one in which offers are invited should be either of the following:

a) Three similar completed works each costing not less than the amount equal to 40% of the
estimated Cost (i.e. Rs. 80,01,865/-)
OR
b) Two similar completed works each costing not less than the amount equal to 50% of the
estimated Cost (i.e. Rs. 1,00,02,332/-)
OR
c) One similar completed work costing not less than the amount equal to 80% of the estimated Cost
(i.e. Rs. 1,60,03,730/-)

Similar work & Completed work are defined by the following activities for any Thermal Power Utilities
like DVC/NTPC/SEBs/Govt./PSU/ other reputed organizations as follows.

Similar works means successful execution of the AMC/ARC for different Mechanical maintenance
/Overhauling work or Erection & Commissioning work of Boiler /Boiler & its Aux./ Boiler Aux.
/Milling System / Boiler and Milling system / Boiler Auxiliaries including Milling system in power
utilities like DVC/NTPC/SEBs/ Govt./ PSU/other reputed organizations having each unit capacity not
less than 110 MW.

Completed works means the executed/completed portion of the AMC/ARC for different Mechanical
maintenance /Overhauling work or Erection & Commissioning of Boiler /Boiler & its Aux./ Boiler
Aux. /Milling System / Boiler and Milling system / Boiler Auxiliaries including Milling system in
thermal power plants like DVC/NTPC/SEBs/Govt./PSU/other reputed organizations having each unit
capacity not less than 110 MW, even if the work has not been completed in totality (subject to furnishing
proof of executed value of the work in the form of certified copies of RA bills) or any relevant
documents, which is sufficient to prove the works completed.

C. Financial Credential
The bidder’s Average annual turnover during last three years ending 31.3.2013 should be at least
30% of the total estimated cost i.e. Rs.60,01,399/- of the work specified in the NIT/Tender.

A tolerance limit of (say) 5 % on the quantum of QR under Sl. No. B & C shall be provided to take
care of the marginal shortfall, if any during evaluation of bids.

D. The following self attested documents, duly sealed should be submitted along with Techno-
Commercial part to substantiate credential criteria mentioned under A B & C above failing which
tender may not be considered without any further reference in this regard:

1. Executed value of the work certified by the concerned authority along with the self
certified copy of LOI/WO/Agreement in support of Credential as per Sl. No. A & B above.
2. Annual Report, Balance sheet and Profit & Loss account of preceding three years ending on
31.03.2013 as certified by a Chartered Accountant.

3. Overall profitability & cash profit as certified by a chartered Accountant during the preceding
three (03) financial years ending 31.03.13.
4. A latest bank solvency certificate indicating monetary limit.
5. Status of the organization i.e. Company Registration Certificate, Article of Association,
Proprietorship or Partnership deed, as the case may be, with documentary evidence.
6. Trade License.
7. A latest STRC/VATRC as the case may be.
8. EPF Registration certificate.
9. Service Tax Registration certificate.
10. ESI Registration.
11. Valid Labour License

Note: DVC reserves the right to call for original documents at any time

Annexure-II
SCOPE OF WORK

1. Overhauling of grinding roll along with journal including replacement of bearing & roller
adjustment:
a. Dismantling of the journal head and old grinding roll from journal assembly. After shifting of the
assembly at the place of servicing.
b. Checking of the bearing float before dismantling of upper and lower journal bearing.
c. Thorough cleaning and inspection of upper and lower journal housing.
d. Removal of damaged bearing with its race with proper heating arrangements and T & Ps, if
required / as per the instruction of the area engineer.
e. Replacement of seal wear ring from the journal shaft, if required as per the instruction of the area
engineer.
f. Repair of lower journal housing oil drain cap & its base by cutting and welding of new plates as
per the instruction of the area engineer
g. Assembly of bearings (upper and lower) and housing after proper upper bearing clearance setting
and “o” ring fixing.
h. Assembly of new grinding roll on the journal assembly if required.
i. Float adjustment and final inspection for float by the area engineer or his representative.
j. Fixing of oil seals with spacer ring & seal keeper.
k. Filling of fresh oil in the journal.
l. Servicing of journal head & trunion shaft assembly.
m. Repair/replacement of all damaged bolts & studs, re tapping of all the threads, and coupling.
Hard facing of all other wear prone parts, servicing of trunion bushing as desired by Site
Engineer.
n. Assembly of the journal head.
o. Shifting of assembly to a suitable place as per directive of EIC.
Job Completion period: 96 hours for one roll.
Defect Liability period: 03 months

2. Journal assembly repair / Replacement of grinding roll tyres outside the mill (excluding
grinding roll & bearing replacement):
a. Removal of coal mill flange/Journal covering frame as per requirement.
b. Removal of grinding roll along with journal outside the mill.
c. Removal of check nut, roll tyres & oil seal.
d. Fitting of oil seal, roll tyre, check nut etc.
e. Oil replacement if required.
f. Placement & fixing of roll assembly in position.
g. Fitting of journal covering frame.
h. Any other work for successful completion of the job as per instruction of EIC.
Job Completion period: 48 hours for one roll.
Defect Liability period: 03 months

3. Repair/Replacement of bowl hub cover:


a. Checking of bowl hub cover for damage/erosion.
b. In situ repair by welding, plate fixing, grinding and hard facing as per requirement.
c. If not repairable in situ then replacement to be done as follows.
I. Grousing of fixing bolt heads if eroded.
II. Removal of fixing bolts by normally or by extraction.
III. Correction damaged thread by tapping.
IV. Fixing of new/repaired vane segments by bolting and adjustment of gap between fixed
part & rotating part.
Job Completion period: 10 hours for one hub.
Defect Liability period: 03 months.

4. Removal and fitting of grinding roll to start other work:
a. Fitting of lifting hook in bowl end and mill body by welding.
b. Fixing of chain pulley block in suitable position.
c. Lifting of journal assembly by proper balancing the weight and removal of the same.
d. Refitting of the journal assembly after completion of the other work.
e. Removal of the lifting hook from bowl and mill body.
Job Completion period: 4 hours

5. Repair/Replacement of rotating vane:


a. Checking of rotating vane and in situ repair by welding, plate fixing, grinding and hard facing as
per requirement.
b. If not repairable in situ then replacement to be done as follows.
I. Grousing of welding joint between rotating vane segment and bowl extension ring .
II. Removal of fixing bolts by normally or by extraction.
III. Removal of 06 nos. rotating vane segments.
IV. Correction damaged thread by tapping.
V. Fixing of new/repaired vane segments by bolting and adjustment of gap between fixed
part & rotating part.
VI. Welding of vanes with bowl extension ring.
Job Completion period: 40 hours for one mill.
Defect Liability period: 06 months.

6. Replacement of multiport outlet:


a. Preparation of scaffoldings as per requirement.
b. Locking of 04 nos. coal pipe properly.
c. Removal of 04 nos. ports by removing fixing bolts. Repair it, if necessary.
d. Fitting of 04 nos. new/repaired ports by bolting.
e. Locking removal of coal pipe.
f. Any other work required to complete the job as per instruction of E-I-C.
Job Completion period: 18 hours for four nos., one mill
Defect Liability period: 02 months

7. Replacement of bowl extension ring:


a. Removal of fixing bolts between bowl and bowl extension ring.
b. Grousing of welding joint between rotating vane segment and bowl extension ring.
c. Correction damaged thread by tapping.
d. Fixing of bowl extension ring with bowl by bolting.
e. Welding of vane with bowl extension ring after proper adjustment of gap.
Job Completion period: 08 hours for one mill.
Defect Liability period: 02 months

8. Replacement of Rockwell/Dresser coupling:


a. Preparation of scaffolding & fixing of lifting equipment as per requirement.
b. Proper locking of coal pipe/mill inlet chute.
c. Removal of Rockwell or Dresser coupling by removing bolts.
d. Replacement of coupling gasket or full coupling after proper alignment of pipe & bolting.
e. Removal of locking.
f. Any other work required to complete the job as per instruction of E-I-C.
Job Completion period: 04 hours for one no.
Defect Liability period: 01 month

9. Replacement of victolic coupling:


a. Preparation of scaffolding & fixing of lifting equipment as per requirement.
b. Proper locking of coal pipe.
c. Removal of Victolic coupling by removing bolts.

d. Replacement of coupling gasket or full coupling after proper alignment of pipe & bolting.
e. Removal of locking.
f. Any other work required to complete the job as per instruction of E-I-C.
Job Completion period: 04 hours for one no.
Defect Liability period: 01 months

10. Cooler cleaning:


a. Dismantling of cooling water and lube oil line.
b. Opening of both side flange and removal of tube bunch if required.
c. Through cleaning of the cooler by nylon brush, water and compressed air..
d. Fitting of cooler.
e. Connection of lube oil line and cooling water line.
f. Any other work as per instruction of E-I-C to complete the job.
Job Completion period: 08 Hours for one no.

11. Repair/Replacement of Dome valve:


a. Reject hopper cutting at proper position for removal of dome v/v.
b. Removal of damaged dome v/v.
c. Removal of lower knife edge gate v/v as per requirement.
d. Reclamation of damaged dome v/v, lower knife edge gate v/v.
e. Refitting of repaired / new dome v/v knife edge gate v/v
Job Completion period: 08 hours. for one no.
Defect Liability period: 06 months

12. Cleaning/Replacement of bag filter of silo:


a. Checking of bag filter and removal of the same from the silo.
b. Cleaning of the bag filter by compressed air or by other means.
c. Refitting of the bag filter in position.
d. Replacement of bag filters if not usable.
Job Completion period: 06 hours for one no.
Defect Liability period: 01 month

13. Liner fabrication & fitting in mill body:


a. Cutting of checker plate or SAIL hard plate of suitable size & thickness by plasma cutter.
b. Bending of plates to the radius of curvature of the mill body by plate bending machine.
c. Fixing of plates on eroded part of the mill body by welding.
d. Hard facing as per requirement.
e. Any other job for completion of the job as per instruction of EIC.
Job Completion period: 06 hours per sq. meter.
Defect Liability period: 03 months

14. Replacement of Bull ring segment by removing clamping ring:


a. Opening of door/frame of coal mill and removal 01 journal assembly.
b. Removal of clamping ring.
c. Removal of broken bolts.
d. Removal of worn out bullring segments.
e. Fitment of new bullring segments by means of properly prepared wedges.
f. Fixing of clamping ring. The bolts should be tightened after applying anti seize compound on the
threads.
g. Hard facing of clamping ring.
Job Completion period: 48 hours for one mill.
Defect Liability period: 08 months.

15. Replacement/Repair of Journal head with other associated work:
a. Repair of all three worn-out journal head. Head to be repaired and hard-faced before the
commencement of the job. Fitment of the prefabricated journal head guard.
b. Repair/Hard-facing all internals as per requirement.
c. Repair/replacement of all damaged bolts & studs, re tapping of all the threads, and coupling.
Hard facing of all other wear prone parts, servicing of trunion bushing as desired by Site
Engineer.
d. Repairing/replacement of grill/plate around the mill.
e. Repair/replacement of journal head guard and journal housing cover.
f. Other related work as per the instruction of the EIC.
Job Completion period: 16 hours for one no.
Defect Liability period: 03 months

16. Journal guard repair/replacement:


a. Removal of journal guard from the assembly by removing fixing bolts & grousing.
b. Removal of top plate of the eroded journal guard.
c. Fabrication of new plate as per requirement.

42. Disposal of mill rejects from silo or mill reject area to reject yard:
a. Placement of tractor trolley below the silo of the coal mill rejects daily or as per direction

c. Shifting the mill rejects to the place inside the plant premises as indicated by the EIC.
d. Payment of this part is as per number of trip of tractor trolley ( of standard size)
e. It is contractor responsibility to dispose as per direction of EIC without ant spillage on the way.
f. In case of outage of coal mill rejection in auto, the contractor has to collect rejects from reject
area and disposed in reject yard as per direction of EIC or its representative.
g. Generally one to two tractor is required daily for one unit in service. Contractor may deploy extra
tractor in case of emergency or during high rejection rate.
h. The contractor has to transport coal generated during clearing of coal feeder or coal mill to coal
yard or any other place as per EIC. Same rate is applicable in this case.
i. Daily Rejection removal from mill reject area is a must in case of unit running. If not removed
timely, a sum of Rs. 1000/- each occasion will be imposed for non- removal of coal rejects
technological waste from the Milling plant area.

Note: - The essence of this part ( sl. no.-54) of contract is to ensure proper availability of equipment in
operating condition and to reduce down time from maintenance point of view and to run the unit with
sustained generation. Accordingly, the contractor has to provide adequate /sufficient manpower which
will commensurate to the quantum & quality of work as indicated in the scope of work so that there
should not be any lapse or shortage of manpower while carrying out the maintenance work against the
contract. The contractor has to provide sufficient manpower on round the clock basis to cater all above
activities. Generally one group consist of one supervisor, two to three Technician and unskilled
manpower (as per requirement) in each shift. For general shift, two to three major complete group
consists all category of sufficient manpower (like Highly skilled/ skilled technician, welder, rigor, helper
etc) for general shift works.

55. Up keeping of mill and feeder area & removal of technological waste from mill reject area:
a. Removal of scraps, debris, other technological wastes related to coal mill & feeder form the
area between PA/FD fan bay to boiler front & LHS mill bay to RHS mill bay, feeder floor etc.
b. Up keeping of mill reject area, Removal of coal dust from mill area ( like- from manual reject
system, motor area, mill base area & surrounding), drain pit, Lub oil skid etc.
c. Accumulation of the wastes in specific areas as per their grade as per direction of EIC.
d. Disposal of different grades of wastes in different areas inside the plant premises as per the
instruction of EIC. However in case of transportation of coal mill reject to coal mill reject yard,
it will be paid as per rate mentioned in Sl no.-42.
e. Any other related work as per instruction of E-I-C. It is responsibility of contractor to make the
area clean .A joint inspection of the above said areas shall be done regularly by the
representative of DVC and the contractor. The deficient areas as indicated by DVC Engineer
during joint inspection shall have to be attended by the contractor positively. Tentatively, six
(6) to 8 (eight) persons are required for both units for execution of work. However it is
contractor’s responsibility to maintain the area by deploying sufficient manpower. If not
attended within decided time frame, proportion deduction will be made

NB: The quantities mentioned above are tentative only. It will vary as per requirement. Actual quantity may

executable quantity for any item. Payment will be made as per actual job done.

1. Penalty clause will be imposed for individual item on delay time or part of delay time which is fully
attributable to the contractor. No penalty will be imposed when DVC or other department/agency are
attributable to the delay in completion of the job. In this regard decision of the Engineer In charge
(EIC) is final
2. In case the contractor can able to complete any item of work before stipulated time frame, then the
difference between stipulated time and completion time will be recorded and the same will be
adjusted annually at the same rate with the penalty time of the same item as reward.
3. Penalty amount will be finalised at the end of the contract period (i.e. after one year from the date of
commencement of the work). However penalty amount if any will be withheld on monthly basis.
4. If any amount is refundable due to early completion of any item of work, this will be adjusted at the
end of the contract period and the payment will be made through subsidiary bills raised by the
contractor. However item wise adjusted amount will never be more than the penalty amount.

Annexure-III
Technical and allied terms& Conditions:

1. Contractor has to deploy sufficient nos. of highly skilled, skilled, semi skilled, unskilled and
experienced man power and supervisors to carry out maintenance of 20 nos. of both the units of coal
mills and other associated jobs at a time subject to availability of PTW within the scheduled completion
period.
2. Contractor has to deploy man power of different categories on all the working days, Sundays and other
holidays to attend various emergency jobs in morning, evening and night shifts as per requirement. The
deployed manpower should include supervisor, welders, technicians, riggers, & helpers etc. as and
when required so that any job can be attended without any delay on round the clock basis.
3. For day to day works in shift and general shift work ( as mentioned in item no-54) , Generally one
group consist of one supervisor, two to three Technician and unskilled manpower ( as per requirement)
in each shift. For general shift, two to three major complete group consists all category of sufficient
manpower for general shift works.. However if situation demands, the contractor has to engage
manpower beyond the specified period of general shift. To carry out other job in rate basis (mentioned
in 1-53 & 55), the contractor has to provide extra manpower as per requirement so as to avoid any
shortage /crisis in other works. Contractor should provide extra skill manpower with extra supervisor, if
required, for proper execution of works.
4. The contractor should have adequate manpower/ infrastructure /capacity to take up 4 to 5 jobs of
different areas simultaneously or more for execution and no job whether critical or non-critical should
suffer for the shortage of manpower.
Note:- Bidders are advised to visit the DSTPS working site of related area to access the work
condition, number of work force required for work, infrastructure available in DSTPS, local / external
environment, prevailing labour rate / cost, present statuary rules etc
5. Contractor has to engage minimum one qualified and experienced supervisor in each shift as well as in
general shift and other supervisor as per instruction of Eng. in charge.
6. The contractor should maintain all T&P's in healthy condition as per enclosed annexure #-IIIA .
Contractor must arrange and maintain sufficient quantities of T&P's like welding machines, cutting
sets, lifting and pulling tackles, chain blocks, hand lamps and torches, grease guns etc in healthy
conditions. Items like cable for welding M/C, regulator for cutting sets and welding M/C, welding
glasses, lighting torches, torch cells & bulbs, hand lamps, gas cutting hoses and cutting torch, hand
gloves, slings of various sizes and loads etc. have to be arranged by the contractor in sufficient numbers
wherever required. Special T&P's like high capacity hydraulic jacks, bearing heating equipment,
special torque wrench etc. will be provided by DVC free of cost, whenever reqd. A list of T & P has to
be kept at site as furnished in Annexure-IIIA which is indicative only for guidance of the contractor.
Any other normal T & P items as required for satisfactory execution of the contract shall have to be
arranged by the contractor. However special T & P will be provided by DVC. Welding machine of
generators/transformers type will be arranged by the contractor as required.
7. Certificate from the statutory for all the lifting equipment, slings etc. have to be obtained by the
contractor at their own cost.
8. Defect liability period for any job will be as per Scope of work of the optional work. In case of any
defect in any job within defect liability period, due to poor workmanship of the contractor, the same
work has to be executed by the agency free of cost.
9. All the spares for equipments will be provided by DVC free of cost, wherever required. One site store
keeper will receive these spares and will submit a periodic report for consumption of these spares and
requirement of spares. M.S. plates / SS plates and other steel material will be provided by DVC as per
requirement.
10. General purpose electrodes, Oxygen & DA gas will have to be arranged by the contractor at their own
cost for all the jobs wherever reqd. Special purpose electrode like SS electrode, stellite electrode, and
hard facing electrode & special maintenance electrode will be supplied by DVC free of cost.
11. Consumables like Petrol, HSD, emery paper/cloth, holdtite, Teflon tape, rustoline, sodium silicate,
nylon brush will be arranged by contractors at their own cost. Electrodes for welding MS to MS should
be as per AWS E 6013. Electrodes for welding Tie rod, Chains and Collars etc. will be as per AWS E
7018. Electrodes for welding journal assembly will be as per AWS E 7018. All the aforesaid electrodes
will be of D&H/ESAB/AOL/AFL/ L&T make only.

12. Contractor must issue safety shoe, safety helmet and other adequate safety appliances to all workmen
and supervisors and ensure the usage of the same during the work.
13. Contractor must do preparatory jobs before start of any work as per the instructions of Eng.-in Charge.
For this contractor must arrange sufficient manpower and T&P's for material shifting to the shop / site
for preparatory jobs as per the instructions of Eng.-in Charge.
14. Any type of machining work as per the job requirement will be arranged by DVC plant work shop free
of cost. However transportation of job to machine shop & assistance in machine shop work like metal
build up, material handling etc. will be contractor’s responsibility.
15. Shifting & handling of materials related to this contract from store to work site and site to other places
inside the plant premises is in the scope of contractor. All the scraps generated during the work must be
shifted to the specified place immediately after the completion of work.
16. Weighment slip for mill rejects/scrap material for each tractor has to be submitted by the contractor if
Weigh Bridge is available inside the plant premises. If Weigh Bridge is not available or out of order,
then certification of contractor supervisor, duly endorsed by DVC representative, is essential.
17. During any work contractor has to furnish check list, duly filled up, of work, as provided by DVC EIC.
Also the contractor has to work as per schedule of different preventive & breakdown maintenance as
provided by DVC EIC.
18. No Cotton Waste is allowed for executing maintenance jobs except for arresting coal dust leakages. For
maintenance purpose old cloth will have to use.
19. Mobile Crane/Hydra (along with driver, diesel & other consumables) of 10/ 12T capacity, for material
handling will be provided by the contractor as per requirement for shifting of materials for related
works and shifting of scraps. The Hydra may be deployed in coal mill and other related areas under SE
(M), boiler & coal mill section as per instruction of EIC.
20. Assistance in monitoring of vibration of Milling Plant equipments at regular interval (by manpower in
shifts) and taking corrective action like balancing etc will have to be done by the contractor.
21. All labour problems and local issues related to the contract have to be looked after by the contractor.
Disciplined behavior of workers and supervisors will be ensured by the contractor. DVC will be not
responsible for any labor or local problem.
22. If any person, employed by the contractor, on any work is found to be incompetent or found to act in an
improper manner, the matter to be brought to the notice of contractor and the said person(s) will have
to be replaced immediately.
23. If in the opinion of the chief engineer or his authorized representative, any of the materials or plant
brought to site for use is not of the quality or kind specified and/or unfit for the work the same shall
have to be removed from site by the contractor.
24. The chief engineer or his authorized representative may order to suspend any work that may be
subjected to damage by the prevailing climate condition/other reasons.
25. As the plant site of DSTPS is a protected area, necessary gate pass of every worker shall be arranged by
the contractor with proper intimation to DVC as per existing rules. The expenditure of photograph, gate
pass shall be borne by the contractor.
26. The contractor shall be responsible to comply with all laws of the land including labour rules and acts
in vogue or as may come into vogue during the validity of the contract and shall indemnify the
purchaser against any claim arising out of any non-compliance and/or accident to third party.
27. The contractor and his labours shall have to follow all safety rules at the time of execution of the work.
All safety gadgets and appliances as required for maintenance of the Coal mill & Auxiliaries shall be
supplied by the contractor to the workmen without any extra cost to DVC.
28. The contractor shall be responsible for the compliance of all the rules and regulation of the plant as
detailed but not to be limited to the following prevailing Acts.
i) Factory Act
ii) Minimum Wage Act
iii) Bonus Act
iv) Contract Labour (Regulation & Abilities) Act as prevalent and the rules and regulations made
therein from time to time and shall indemnify and hold harmless the purchaser/owner against any claim
arising out of compliance or any non- compliance and/or accident to the third party.
29. Any other requirement of activity not envisaged/covered above but essentially required for
completeness of successful execution of the contract shall be to the contractor's scope.

30. Settling of the local dispute will primly be done by the contractor. However DVC will assist them as
per rule if possible.
31. The contractor shall arrange necessary watch and word for their store at site.
32. The contractor has to carry out the preventive maintenance of the equipments as per attached annexure
if permit is available from operation.
33. Site in charge and Engineers, engaged against the contract, should not leave DSTPS site without prior
permission of the DVC, EIC.
34. The contractor shall submit a list of Engineer / Supervisor / technician etc. having experience of similar
type job for approval of the same by DVC, EIC. After getting approval from DVC, EIC, they may be
deployed for the job.
35. One liaison personnel (Asstt. grade rank) should be stationed by the contractor at SE (M) office during
general shift for doing liaison work between the contractor and the DVC official.
36. The contractor is enjoined to place additional man-power as a provision of need support round the
clock.
37. Payment for the jobs from item Sl. Nos. 1 to 52 will be made as per actual execution of the work.
Payment for item no. 53 will be made as per actual deployment of the manpower certified by Operation
In charge on prorate basis. Payment for the jobs under Sl. Nos. 54 & 55 will be made on monthly basis.
Separate billing has to be done for item no. 53 to operation checking as necessary.
38. The contractor should obtain the test certificate for all the equipments like safety gadgets, lifting
equipments, winch, lifting slings etc. from the statutory authority in due time and a copy of the
certificate have to be furnished to safety officer, DVC.
39. The contractor should arrange medical checkup for all of his employees, engaged in the work, as per
the rule of Govt. of India at their own cost.
40. Special clause of the contract
a. The completion period and defect liability period for each individual work would be as per scope
of the work and time schedule sheet.
b. Contractor will ensure availability of vehicle preferably on round the clock basis. This vehicle may
be used for transporting of manpower from residence to work site or may be used inside or outside
power house as per instruction of E-I-C for DVC work or in case of emergency.
41. Safety gadgets charges:
a. Contractor will ensure safety gadgets to all workers for all work.
b. All safety gadgets will be ensured at site as per list.
c. Certificate from the statutory for all the safety gadgets have to be obtained by the contractor at their
own cost.
d. Proper scaffolding for all jobs must have to be ensured for safety reasons. Scaffolding materials
from time to time will be verified by E-I-C.

Annexure-IV
COMMERCIAL TERMS AND CONDITIONS

1. Rate: Rate shall be firm throughout the contract period. The rate shall be inclusive of all taxes &
stationary charges as applicable but excluding of service tax. Service tax as & if applicable shall be
paid extra as applicable against submission of Service Tax Registration certificate.
2. Validity of the offer: The offered rate shall remain valid for acceptance for a period of 180 days
from the date of Bid opening.
3. Contract Period: For a period of 01(one) year from the date of commencement of work with a
provision of extension of another one (01) year at the same Rate & Terms and Conditions subject to
review of performance and at the sole discretion of DSTPS, DVC.
4. Terms of Payment:
a. 100% payment shall be made against monthly RA bills on presentation of bills in triplicate pre
receipted in original copy after statutory deduction as applicable subject to satisfactory
completion of the jobs duly certified by the Engineer-in-charge and acceptance of S.D.B.G/
Advance Bank Draft towards Security Deposit and execution of the agreement.
OR
b. 90% payment shall be made against monthly RA bills on presentation of bills in triplicate pre
receipted in original copy after statutory deduction as applicable subject to satisfactory
completion of the jobs duly certified by the Engineer-in-charge and acceptance of I.S.D and
balance 10% shall be paid after expiry of the claim Period.
No payment will be made without acceptance of SDBG/ISD. Service tax shall be paid extra as per
admissible prevailing rate along with the respective invoices. Statutory taxes whichever is applicable
will be deducted from the bills .EPF & ESI clearance is mandatory.
5. Security Deposit cum Performance Guarantee: The successful bidder have to submit 10% of total
value of order in the form of Advanced bank Draft/ Security Deposit Bank guarantee (S.D.B.G) from
any Nationalized/ Scheduled Commercial Bank valid till expiry of the Contract period with a claim
period of another 06 (six) months in DVC’s prescribed format. The Security Deposit is to be
submitted within 30 days from the date of placement of WO. If the bidder fails to fulfill the
agreement of the contract, their claims, whatsoever, include B.G. as S.D. shall be forfeited. In case of
extension of the contract, the Security Deposit/Bank Guarantee has to be extended accordingly as per
rule.
OR
The successful bidder have to submit 2% of total value of order as Initial Security Deposit (ISD) in
the form of Advanced bank Draft/ Security Deposit Bank guarantee (S.D.B.G) from any
Nationalized/Scheduled Commercial Bank valid till expiry of the Contract period with a claim period
of another 06 (six) months in DVC’s prescribed format. The Initial Security Deposit is to be
submitted within 30 days from the date of placement of WO. 10% of the WO value will be deducted
towards Security Deposit and paid after the expiry of the guarantee period. No interest will be paid on
the Security Deposit amount.
EXEMPTION: SSI Units registered with NSIC, under its single point registration scheme, are
exempted from depositing Security Deposit for ordering value up to the monetary limit for which the
unit is registered. Small Scale Industries seeking such exemption must enclose valid registration
Certificate from appropriate Govt. Authority giving details such as validity, stores, monetary limit etc
failing which exemption will not be granted.
However, these SSI units will have to submit Performance Guarantee as per DVC norms and no
payment will be effected till the acceptance of the same.
6. Defect Liability Period: The contractor shall stand guaranteed against defects attributable to faulty
workmanship or procedure adopted in the total work for items covered in the contract for a period of
as mentioned in the BOQ (Annexure-II B) from the date of re-commissioning of the set after
completion of the mentioned work. The guarantee covers all defects notified during this period and
shall have to be attended to free of cost immediately or at the time DVC is able to give shut down of
the set. In case of failure to do so, DVC shall arrange to attend the defects and the charges shall be
levied to the account of the contractor and shall be recoverable from the contractor’s bill / security
deposit.

7. Performance Guarantee: The contractor shall stand guaranteed against defects attributable to faulty
workmanship or procedure adopted in the total work for items covered in the contract for a period of
six months from the date of re-commissioning of the set after completion of the mentioned work. The
guarantee covers all defects notified during this period and shall have to be attended to free of cost
immediately or at the time DVC is able to give shut down of the set. In case of failure to do so, DVC
shall arrange to attend the defects and the charges shall be levied to the account of the contractor and
shall be recoverable from the contractor’s bill/security deposit.
8. Contingency: - Contractor must possess sufficient fund to pay the workers when bills are not
paid/passed for reasons whatsoever for at least two months.
9. L. D. Clause: - The time remains the essence of the contract, for major breakdown/preventive/routine
maintenance job a mutually agreed time frame shall be fixed on each occasion prior to
commencement of work. DVC reserves the right to recover a sum equivalent to 0.5% of the value of
the delayed work for each week of delay and part thereof subject to maximum of 5% of the total
order value as liquidated damage due to delay in completion of work attributable to the bidder.
10. Other Penalty Clause:
a. In case of violation of safety norms and in case of failure in shifting of scrap material to the
specified place in specified time, DVC may charge a penalty of Rs. 500/- (max) on each
occurrence as per discretion of E.I.C.
b. Daily Rejection removal from mill reject area is a must in case of unit running. If not removed
timely, a sum of Rs. 1000/- each occasion will be imposed for non- removal of coal rejects
technological waste from the Milling plant area.
c. T&Ps of the contractors would be checked from time to time during the contract period. In
absence of any T&Ps & Supervisor during the work or in case if the work is hampered due to
non healthiness of T&Ps, DVC may charge a penalty of Rs. 500/- on each occurrence as per
discretion of E.I.C.
d. Penalty for delay in execution of each job is stipulated in annexure II B.
e. If any work related with coal mill as mentioned in scope of works will not be done as per
requirement / unnecessarily delay/ refused to work as the case may be, DVC has right to get it
done by engaging other agency and a penalty of 1.5 times of the rate, on which the work has done
by the other agency, will be imposed on the contractor.
11. Site Mobilisation: Site mobilization should be done within a period of fifteen (15) days from the
date of placement of LOA/LOI/WO or intimation from the Engineer-In- Charge. If the contractor
fails to mobilize the site within the specified period from the placement of LOI the expenditure
incurred for carrying out the job beyond fifteen (15) days by the existing Contractor or alternative
agency as/if applicable shall be charged on the successful contractor and the same will be deducted
from the Contractor’s running bill/bills as per decision of DSTPS, DVC, Authority. No advance
payment towards mobilization will be provided by DVC.
12. Agreement: - Bidder shall have to execute a contract agreement in the prescribed DVC format on a
non-judicial stamp paper of appropriate value only failing which no payment will be made to the
contractor.
13. Subletting: - The vendor shall not sublet any part of the contract to any other vendor/agency without
the prior written consent of the owner. Such assignments or subletting or transfer shall not relieve the
vendor from any obligation, duty and responsibility under this contract. Any assignment, transfer
subletting without the prior approval of the owner shall be void. The owner shall have the right to
cancel the order/contract and to get the services from elsewhere and the vendor shall be liable to the
owner for any loss or damage which the owner may sustain in consequence or arising out of such
contract and the vendor shall indemnify such loss or damage to the owner.
14. Termination Clause:- The Contract may be terminated as per the following DVC’s GCC
guidelines:
a. DVC may terminate/Short Close the contract, by not less than 30 days written Notice to the
bidder, to be given after occurrence any of the events specified in the Sl. No. (a) to (e) of this
clause and 60 days in the case of the event referred to Sl. No. (g), (h) & (f) below.
b. The bidder fails to comply with any of the terms of the order or the bidder do not remedy a failure
in the performance of their obligation under the contract, within 30 (Thirty) days after being
notified or within any further period as the owner may have subsequently approved in writing.
c. The bidder becomes bankrupt or goes into liquidation.

d. If as a result of Force Majeure, the bidder is unable to execute the job for a period of not less than
60 days.
e. If the bidder, in the judgment of the owner has engaged in corrupt or fraudulent practices in
competing or in executing the contract. For the purpose of this clause ::
f. “Corrupt Practice” means the offering, giving, receiving or soliciting of any thing of value to
influence the action of a public official in the selection process or in contract execution.
g. “Fraudulent Practice” means a misrepresentation of facts in order to influence a selection process
or the execution of a contract to the detriment of the owner.
h. The bidder is otherwise precluded from complying with any of the terms of the order on account
of any directives of any lawful authority.
i. If the owner, at its sole discretion, decides to terminate this contract.
15. Conditions for Forfeiture of EMD-The same shall be applicable as per relevant clause of GCC.
16. Deviations: Deviations, if any, from the tender specification shall be clearly mentioned by the bidder
in Deviation Sheet indicating the relevant specification clauses.
17. Any other requirement of activities not envisaged/covered above but essentially required for
completeness of successful operation of entire system shall be to the Contractor’s scope without extra
cost.
18. The Contractor shall obtain necessary certificate from competent Authority of the Central Govt. of
that all legal formalities of prevalent labour contract (R&A) Act have been completed by the
Contractor.
19. All tenderers would be bound by the terms & conditions as detailed in the tender specification &
DVC’s General Conditions of Contract (GCC) as per applicability. Bidders are requested to go
through GCC on DVC website available in http://www.dvc.gov.in/GCC-2012.pdf.

Other Terms and Conditions of the Contract

1. Insurance: - The Insurance of personnel employed in the job shall be done by the contractor. No
compensation of any major/minor/disabilities/damage would be given by DVC, DSTPS. ESI
also to be complied with by the contractor.
2. Permit to Work: For any job ‘Permit to Work’ is to be obtained from the Control Room through
Engineer-in-charge of DVC or his authorized representative.
3. Safety measures: - The workmen under tenderer control working in the vicinity of running
equipment are to be given proper safety gears and to be careful to avoid any accident, loss of life or
damage to DVC, DSTPS property. Guide line for action in respect to safety measures for the job are
specified hereunder :-
 The Tenderer is to ensure safety of their workers at site, while working and to provide all kinds of
safety equipment required for the job like safety belts/safety ladder/safety net personal protective
devices etc. to their workers.
 Tenderer will be liable to pay compensation, if any, to their worker for accident “Arising out and
in course of employment”, under the Workmen’s compensation Act.
 Before execution of the job at site Tenderer will have to take clearance from DVC’s safety
department.
 Safe scaffolding as certified by Safety Department be used before start of work.
 Contractor is to abide by Mandatory Safety clauses enclosed.
DVC, DSTPS IN NO WAY SHALL BE RESPONSIBLE FOR SAFETY OF CONTRACTOR’S
WORKMEN.
4. Precautionary measures to avoid damage of other equipment: - The contractor should take care
for safety of equipment and property of DVC, DSTPS. Any loss to this effect will be contractor’s
responsibility entirely and they shall have to make good for the losses and extra expenditure incurred
by DVC, DSTPS thereof. Responsibility of the spares & materials issued to the Contractor rests with
the contractor himself. Contractors have to replenish the same at his own cost & risk in case of
loss/damage of the spare/material under his custody.
5. Discipline: - The contractor’s employees should maintain proper discipline and behavior and do not
cause any hindrance to smooth running of the Power Plant or in execution of duties by DVC, DSTPS
Employees. Controlling Officer is fully empowered to ask the contractor to withdraw any

worker/workers on charges of misconduct, incompetence/ negligence in discharge of duties and such
worker/workers may not be deployed without his permission.
6. Cleaning of Site: The job will be considered incomplete until worksite is free from scrap, rejects and
other wastes etc.
7. The Contractor shall abide by all statutory requirements promulgated by central/state government
and local authorities.
8. Laws :-
a. Tenderer should have to abide by all Statutory Acts and Laws and Regulations of respective
Government.
b. Tenderer shall be responsible for compliance of all statutory obligations under Factories
Act.1948, Contract Labour Act, Minimum Wages Act, Payment of Wages Act and also be
responsible for payment of employees contribution under EPF etc.
c. Tenderer has to obtain labour license from statutory body i.e concerned office of the Regional
Labour Commissioner (Central) as applicable.
d. Tenderer shall have to obtain license from Govt. License authority under Contract Labour
Regulation and Abolition Act and the copy of the same will have to be produced.
e. The workers deployed by tenderer will be bound by regulation of Factories Act. 1948. Minor and
women labours shall not be engaged in this job.
f. Xerox copies of the documents showing deposit of EPF amount to the EPF department of Govt.
should be submitted to the controlling officer and personnel department every month before
submission of monthly bill for payment.
9. Labour Regulations and Minimum Wages :- The tenderer shall abide by the provisions of the
contract Labour Act 1970 for which the tenderer to maintain records as necessary in terms of
minimum wages act read with the other statutory provisions. The provisions under the Factory Act
1948 as amended from time to time shall have to be complied with by the tenderer.
10. Ex-gratia/Bonus, leave salary, retrenchment benefit etc. shall be paid by the contractor to their labours
as per Bonus Act and other relevant statutory Acts at their own cost. No extra payment shall be made
by DVC in this regard.
11. The contractor shall obtain necessary certification from Govt. labour officer, that all required legal
formalities of prevalent Labour Contract (RA) Act have been completed by the contractor. However,
DVC will issue necessary Form-V after placement of work order.
12. Local Rules & Regulations: - The contractor has to abide by the rules and regulations framed by
DVC authority which may change from time to time in the interest of the project. They are to follow
the duty hours as will be specified by the controlling officer during execution of contract.
13. Security Gate Pass: - The contractor has to arrange Photo gate pass at his own cost for his workmen
from the security department and the rules and regulations related to this subject shall be binding on
the contractor.
14. Withdrawal of workmen: - In case of any worker is found hampering the interest of the project in
any way DVC reserves the right to take appropriate action. In such case, contractor shall have to
replace such workmen within 3 days notice from the controlling officer.
15. Safety of Working Personnel: - DVC in no way shall be responsible for safety of contractor’s
workmen. Contractor should supply the necessary protective devices for safety of their workmen and
contractor will ensure that necessary safety precautions have been taken for contractor’s workmen.
PPE issue register to be maintained & to be shown to Engineer in-charge on demand.
16. Noncompliance of safety regulation and practice in every occasion calls for penalty as deemed fit by
DVC DSTPS Safety Department. The contractor should abide by all the O&M safety rules as laid
down by DVC DSTPS during the execution of the contract.
17. Supervisor of the job will always ensure that safety norms are to be followed during the execution of
the job at site and for any deviation he will immediately inform to EIC.
18. Attending in the Safety training by workers of the Contractor is mandatory. The venue and period of
the same will be intimated by the EIC.
19. Accident: - In case of any accident of contractor’s workmen, contractor are to arrange necessary
prima facie requirement immediately after the incident. DVC shall in no way be held responsible to
compensate contractor workmen be it on duty or not. No benefit in any form shall be admissible in
such case.

20. Payment to Workmen: - Contractor shall have to make wages/salary payment to workmen within 10
days of succeeding month failing which the order may be terminated without further reference.
Monthly salary/wage sheet shall have to be submitted to (One copy) the Personnel section.
21. Canteen facility: - Canteen facility may be extended to working personnel of the contractor on
chargeable basis.
22. Workers compensation: - All the workers under the contract must be paid compensation as per
Workmen’s Compensation act in case of injury or death in course of employment while on duty, by
the contractor at his own cost.
23. The contractor shall be solely and wholly responsible for any accident that may occur during
execution of the work and also for injury to person/persons or damage to the property of any
description whatsoever caused during the execution of the work. In the event of any such accident,
the contractor shall be responsible and shall pay proper compensation for the same as per Workmen’s
Compensation Act. The contractor shall keep the occupier i.e. DVC safe, harmless and indemnified
against all claims and expenses, for any such damage or injury etc. to any person or property.
24. Contractor should furnish P&T / Mobile Numbers of the responsible contact person(s) for
emergency need.
25. The contractor shall be fully responsible for his workers with regard to terms of employment. DVC is
not responsible in any manner, whatsoever in respect of workers engaged by the contractor for
carrying out the work at DSTPS, DVC. During execution of the Contract as well as on expiry of the
same, the contractor shall ensure that none of their employees/workers claims employment in DVC.
The contractor while engaging or disengaging their employees/workers shall also follow all statutory
rules & regulations applicable as per workmen’s compensation Act.
26. Compliance of EPF & ESI scheme for the workers engaged by the bidder shall be applicable as
per rules.
27. Mandatory Safety Clauses of the Work Contract (Tenderer’s responsibility):-
 Contractor has to arrange a full set of First Aid Kit for attending to manpower deployed by him at
site as per requirement.
 Contractor shall be vigilant to ensure provisions of Factories Act 1948 and other statutory
provisions as applicable in respective Power Plant.
 Contractor’s responsibility is to collect copies of prevailing rules from safety department of the
plant.
 Contractor must ensure use of Personal Protective Equipments by their workers.
 Industrial HELMET, Safety-shoes, safety belts etc. shall be issued to each worker by the
contractor.
 Other Personal Protective Equipments necessary for execution of the work shall have to be
supplied by the contractor to their workers which must be approved by Safety Department of the
Plant before commencement of work.
 The contractor shall ensure periodic testing/examination of equipment as well as safety of tools
and tackles, used by them as per provision of Factories Act and rule and maintain the up to date
record for the same at site for inspection of departmental Engineer/Safety Department on
demand.
 The contractor will ensure medical examination for its workers who are working at hazardous
areas before commencement of work and once in every year by qualified medical practitioners as
per provision of the Factories Act 1948 and W.B. Factories Rule and maintain a Register for the
same for inspection by respective O&M Department/Safety Department on demand.
 The workers employed by the tenderer should be suitably skilled for the respective job
requirement otherwise head of concerned O&M department shall have the right to disallow the
unsuitable worker.
 No child labour shall be engaged by the contractor as per statutory rule of Govt. of India.
 The staff engaged by the contractor should not be under addiction of drug/liquor while on duty. It
would be obligatory on the part of the contract to remove any such worker from the job whose
action or conduct in the opinion of DVC management is detrimental to the interest of
Corporation.
 In case of injury, contractor will send the injured person to Hospital/Dispensary/First aid Centre
with verbal intimation to the O&M Department under whom he works as well as to safety

department. The contractor shall submit periodical progress report about the treatment till the
injured worker is certified fit by Govt./Govt. Registered doctor and the said fit certificate is to be
submitted to safety department before resumption of work by the said injured workers.
 The contractor shall report about serious injury/fatality of their workers to local police station,
DM, Safety Department and O&M department within two hours but written report shall have to
be submitted in prescribed from to safety department, P&A and O&M department positively
within 4 (FOUR) HOURS.
 If any accident occurs due to willful violation/non fulfillment of conditions of contract/safety
rules in spite of caution letter by safety department, Party will be subjected to penal deduction as
per rule.
28. Settlement of Disputes and Arbitration::
a. Any dispute(s) or difference(s) arising out of or in connection with the contract shall, to the
extent possible, be settled amicably between the owner and Bidder.
b. In the event of any dispute or difference whatsoever arising under the contract or in connection
herewith including any question relating to existence, meaning and interpretation of the contract
or any alleged reach thereof, the same shall be referred to the Secretary, CEO of Damodar Valley
Corporation, Kolkata – 54 or to a person nominated by him for arbitration. The Arbitration shall
be conducted in accordance with the provisions of arbitration and conciliation law 1996 or
latest and the decision/judgment of Arbitrator/Arbitrators shall be final and binding on both the
parties.
c. However, in case the bidder is a Central Public Sector Enterprise/ Govt. Department, the
dispute arising between the ‘Owner’ and the ‘Bidder’ shall be settled through Permanent
Arbitration Machinery (PAM) of the Department of Public Enterprise, Govt. of India as
per prevailing rules.
d. All suits arising out of this enquiry and subsequent contract, if any, are subject jurisdiction of
Court in the City of Kolkata only and no other court, when resolution/settlement through mutual
discussion and arbitration fails.
