In the post-Trialogue version of #AMLR proposal Article (41a) “Unwarranted de-risking, non-discrimination and financial inclusion” was deleted. It was introduced by the European Parliament in 2023 as a result of the BTC Coalition's human rights advocacy campaign - our testimonials about the financial exclusion in the #EU as a result of transnational repression organised by the authoritarian regimes. Article (41a) was intended to prevent unwarranted de-risking by ensuring that credit and financial institutions have controls and procedures in place to avoid unjustified refusal or termination of business relationships with certain categories of customers. 4/5

On December 3rd, the #ECHR, in Yevstifeyev and others v. Russia, found that domestic authorities’ failure to comply with the positive obligation to respond adequately to homophobic-motivated physical threats and verbal assault by a politician to LGBTI applicants constitutes a violation of Article 14 of the Convention taken in conjunction with Article 8, the right to private and family life. This decision further reinforces the Court’s stance in Hanovs v. Latvia that the failure to address hate-motivated incidents can normalise hostility towards LGBTI individuals, perpetuate a culture of intolerance and discrimination, and encourage further acts of a similar nature. Both of these judgements serve as a recall of the State’s positive obligations in effectively addressing hate crimes against LGBTI people, especially amidst the rise in hate incidents in a number of countries within the Council of Europe. One of the best conversations I had with great minds on the #UNTaxConvention During this year's Pan-African Conference on Illicit Financial Flows (IFFS) and Taxation: THEMED: “Africa’s Tax Agenda in Combatting Illicit Financial Flows: From Words to Action” which took place in Tunis, Tunisia from 26th – 28th June 2024------ I was privileged to be in the panel with one main objective: Dissecting the Nexus between Debt and Illicit Financial Flows (IFFS) and Taxation conundrum in Africa One major issue that came out-- Illicit financial flows are multidimensional and transnational in character. Like the concept of migration, they have countries of origin and destination, and there are several transit locations. The whole process of mitigating illicit financial flows, therefore, cuts across several jurisdictions. Every year, the UN reports on the intimidation and reprisals faced by those who cooperate or are perceived to cooperate with us – it’s the annual report of the Secretary-General on intimidation and reprisals for cooperation with the UN, presented by Assistant Secretary General Ilze Brands Kehris today to the Human Rights Council. This year’s report shows that growing restrictions on fundamental rights and freedoms, coupled with increased surveillance, are shrinking civic space globally and fuelling fears of reprisals. In fact, some cases and countries couldn’t even be included in this report because the victims felt the risks were too high. The findings are disturbing. Victims, Human rights defenders, journalists, lawyers, activists and others have faced reprisals and serious related human rights violations and abuses such as enforced disappearances, arbitrary detention, torture, and even killings for their work. Women, Indigenous Peoples, and young people are especially at risk. For the first time, we’ve documented reprisals against young people due to their engagement with the UN, with at least 20 cases affecting both young men and women. To deliver on its mandate of maintaining international peace and security, the UN needs and relies on the voices and the cooperation of the peoples it serves. Zero tolerance, awareness and prevention continue to be the best response to intimidation and reprisals. We, and the whole UN system are determined to continue addressing the issue firmly and swiftly, including through the Agenda for Protection, which was co-launched by the Secretary-General and the High Commissioner. I am pleased to see that the Organization for Security and Cooperation in Europe's (OSCE) Parliamentary Assembly will adopt a resolution in Bucharest addressing the deteriorating human rights situation in the Transnistrian region. This is a critical step towards addressing the severe abuses and pervasive climate of impunity in the region, as highlighted by Promo-LEX, a human rights organization. Promo-LEX's reports have consistently shown a steady decline in human rights conditions in Transnistria over the past three decades. Fundamental rights and freedoms, such as freedom of expression, are viewed as threats to "security" by the authorities. The region's penal code is highly punitive, leading to alarmingly high incarceration rates. As of January 1, at least 1,785 people were illegally detained in Transnistria, translating to roughly 450 people out of every 100,000 inhabitants being imprisoned. As Promo-LEX's lawyer, I emphasize that all legislation enforced in Transnistria is unconstitutional and contradicts Moldovan law. The Tiraspol regime continues to manufacture numerous political cases, resulting in harsh sentences and inhumane conditions for prisoners. This resolution by the OSCE Parliamentary Assembly is a significant move towards justice and human rights for the people of Transnistria. The ABA Rule of Law Initiative, ABA Center for Human Rights, and USAID are collaborating on a new Human Rights for All project to enhance human rights protection, combat abuses, and promote democracy in #Guatemala. The project involves supporting local human rights organizations, including #Indigenous groups, to strengthen resilience against violations and corruption. The five-year project aims to prevent the exodus of justice sector actors and promote legal mechanisms to combat impunity. As always Senator Kim Pate delivers a compelling clear and courageous call to action. One of my first jobs in Canada was in a small rural community where a group of women leaders, chief among them my then friend Jean Renault (who sadly left us way too young in 1993), started a family violence prevention program. It became crystal clear to me that the systemic underpinnings of domestic and intimate partner violence ran so deep it seemed at times impossible to conceive of change. So one victim at a time I learned that violence is way more than an interpersonal issue. It is a societal failing. Kim calls for epidemic style funding to sustainably and systemically prevent home being the most dangerous place for women and I share her passion for a world where your gender no longer means you are subordinate. She rightly points to recent disturbing trends where young men emulate what president elect Trump described as “your body my choice”. The only way forward is to not turn back that clock but build on the little progress we have made. And it starts with calling out misogyny, providing a way out of poverty which keeps so many women stuck in abusive relationships and stopping an over reliance on laws alone that have close to never led to justice for women experiencing abuse. 8moThe deletion of Article 41(a) is truly shameful and clearly demonstrates where the priorities of the Member States lie. No problem with a little de-risking, so long as their surveillance apparatus remains in place.
