I'm a bit confused by tipping waiting staff in the UK. I thought the 'service charge' (when charged) had superceded the requirements for tips. Otherwise, one is tipping twice. Of course, it's fine to tip if service was above and beyond, as one is then topping up (ie on top of the base charge). With the new law: 1) will staff receive all of the service charge as well as tips? 2) a business can be fined if it withholds tips from staff... and must pay staff by the end of the following month. So if it is not given out at the end of the shift, how do staff know if the business is holding some back. Proving that a restaurant owner is keeping some of the tips would surely be impossible...? I don't run a restaurant (though I worked in some in my younger years), but I'm curious as to how this does/will work. https://lnkd.in/eDnuU433

Restaurant Owners: Employee or contractor? Error: Mixing up employees with independent contractors, or failing to classify exempt/non-exempt employees correctly. Solution: Assess positions in detail and make sure that each worker is correctly classified to avoid severe penalties. Ever wondered what happens to the service charge added to your restaurant bill or the coins you put in the tip jar at your local cafe? How much actually reaches the people who served you or cooked your food? Currently this is up to the business how this money is distributed, but that’s all due to change from 1 October 2024 with new legislation on tipping coming into force. A few key points: * In addition to a policy about treatment of tips, businesses need to create further documentation to keep records of tips distributed. * You need to include zero hours and agency workers. * Fair distribution doesn’t necessarily mean treating all employees the same.
