Read my in-depth analysis of the recent Stuart Barnes IR35 case on AccountingWEB.co.uk. He lost in the Upper Tribunal last week having won at the FTT last year. The case gives analysis of the third stage of RMC, the 12 factors used by the FTT and why the Upper Tribunal remade the decision instead of remitting it back to the FTT again. I applaud this decision as it saved everyone a lot of time and money. The decision, however, didn't go so well for Stuart Barnes but he can, of course, appeal it. This is the fifth consecutive win for HMRC. So, this is the fifth time the Upper Tribunal has decided that the FTT made an error in law in deciding on IR35. Four of those cases are on TV presenters and one was on an IT contractor. I think it is time for a statutory test. #IR35 #Contractors

Following on from a rather lively discussion in this Morning's episode of #CoffeeWithTheHashtagGuy I had an email about a Role and it is actually nice to see an Agent at least attempting to make being Inside IR35 fairer.. PAYE Rate: £550/day (negotiable) PAYE: Employer NI is paid for by the client. The Client's (I removed the Client name for confidentiality purposes - Jon) hiring policy states that all contractors must be engaged on a PAYE basis. I've long said, based on my understanding of the legislation, that being made to pay the Employment Taxation (Employers' NI and the Apprenticeship Levy) when Inside IR35 is illegal & unfair so it's nice to see an Agent at least try be a little fairer. If you, like #JonTheHashtagGuy and several of my CWTHG Community, have been impacted by IR35 killing the Market why not reach out to your MP? It's an Election Year and we have an opportunity to have them actually listen to us. Spreadsheets combined with bridging (filing) software will be a good solution for many. Bridging software also useful for those that would like to stick with existing accounting software that won’t be MTD ITSA compliant.

In December 2023, HMRC published its Help to Comply manual GfC4 on compliance with the Off-payroll Working rules. I've written an article for Contractor UK Limited on the highlights of the compliance manual from a contractor's perspective. Despite the fact this manual is written for the hirer, it is very useful for the contractor to know what is expected from the hirer. This includes advice on the Status Disagreement Process. From my point of view, this is useful guidance and it is free. So, I would recommend making yourself familiar with the contents. Incidentally, training is top of the list and something that I am seeing more clients request. This is training in IR35 and Off-payroll and in the workings of CEST. Pensioners' Fuel Allowance. Everyone's getting in a right lather about it. Because it's an easy stick to beat Starmer with. The problem is - no-one's actually addressing the REAL problem. Why is the Pension so low that it needs to be topped up to stop people freezing to death? We have the lowest national pension rate in Europe. We have the highest energy prices in Europe. We have the highest food prices in Europe. We only have to fix ONE of those issues, and all those white haired grannies (and Toyah Willcox) will be safe. FFS people. I was recently asked to assist a utility contractor fund a £300k+VAT specialist commercial vehicle. They were initially hiring the asset in at £13k per month - we secured the finance at around £6500 per month, halving the cost and giving them an asset they own. The challenge was the VAT payment of £60k that they assumed they needed to pay up front. They simply didn’t have the cash flow available to complete the purchase and halve their cost. We negotiated the finance to include a 3 month VAT deferral meaning they could complete the purchase straight away, reclaim the VAT immediately and then make the VAT payment in 90 days. This transformed the situation and was something they didn’t know was possible.
