She danced onstage with Pitbull. Offstage, dancers Sherhan Rodriguez and Magdielle Bracoviche were in a relationship. Fixtures of the Miami scene, the young, good-looking couple turned heads at clubs and restaurants. But attorneys for both tell PEOPLE that the on-again, off-again relationship between Rodriguez and Bracoviche was often tumultuous – and everything came to a head on November 26, 2015. That’s when, police say, Sherhan became enraged at his girlfriend after finding pictures and text messages he didn’t like on her cell phone. According to a police report, Rodriguez allegedly became aggressive and attacked Bracoviche in her car, slapping her with an open hand numerous times. Then, according to the police report, he allegedly struck her so hard in the face that she almost crashed her vehicle. Two witnesses told police that they saw Rodriguez strike Bracoviche, the report says. According to the report, Rodriguez got out of Bracoviche’s car when they got to the parking garage of her apartment building, only to jump back in through the passenger-side window. Among the evidence against Rodriguez: a surveillance video that appears to show him chasing after her car at her apartment building. The video, obtained by PEOPLE, does, indeed, show Rodriguez diving into the passenger side window of the vehicle. Both sides acknowledge to PEOPLE that the confrontation that evening became physical, but they disagree over who was the aggressor. Rodriguez hired high-profile attorney Jose Baez, who has represented Casey Anthony and Nick Gordon. Baez tells PEOPLE that his client had historically been a victim of domestic abuse at the hands of Bracoviche. A video shown in court – and viewed by PEOPLE – shows an earlier incident from last September. In the video, Bracoviche appears to aggressively follow Rodriguez around an apartment, yelling at him. It’s unclear whether she hits him, but at one point he shows a red mark on his neck to the camera. The accompanying police report, which was also obtained by PEOPLE, alleges that Bracoviche “kept slapping Mr. Rodriguez on his head and face.” “The November 26 incident was not the first time that things had gotten physical,” Baez tells PEOPLE. “Ms. Bracoviche has hit my client many times before. She was often the aggressor; that was the nature of their relationship.” But Bracoviche’s attorney disagrees, noting that she has never been charged with domestic violence. “The relationship, which is over, definitely had its challenges,” says her attorney Alex Strassman. “But nothing ever happened that approached the violence of November 26, 2015. That’s when Mr. Rodriguez struck my client.” Last week, a judge issued a restraining order against Rodriguez, telling him to keep his distance from Bracoviche. The case will go to trial later this year. Close
