Procedural law for recourse against an arbitration award (other than applications for setting aside) 👉 S 33 of the Arbitration Act provides that a party, with notice to the other party, may within 30 days of receipt of the arbitral award (unless another time limit has been agreed by the parties) request the arbitral tribunal to correct any computation errors, any clerical or typographical errors, or any other errors of a similar nature in the award. 👉Additionally, if agreed by the parties, a party, with notice to the other party, may request the arbitral tribunal to give an interpretation of a specific point or part of the award. 👉If the arbitral tribunal considers the request made by a party to be justified, it must make the correction or give the interpretation within 30 days of receipt of the request, and the interpretation will form part of the arbitral award. The arbitral tribunal may also correct any errors of the kind referred to above on its own initiative within 30 days of the date of the award. 👉Section 33 also provides that a party may request the arbitral tribunal, with notice to the other party and within 30 days of receipt of the award, to make an additional award regarding claims presented in the arbitral proceedings but omitted from the arbitral award, unless otherwise agreed by the parties. 👉The arbitral tribunal is required to make the additional arbitral award within 60 days of receipt of the request, if it considers the request to be justified. 👉If necessary, the arbitral tribunal may also extend the time limit within which it can make a correction, give an interpretation or make an additional award. The provisions of section 31 apply to a correction or interpretation of the arbitral award or to an additional award made under section 33. 👉Although an award may be corrected on the grounds mentioned above (s 33), the retractation of an award on any matter of substance is not permissible by the arbitral tribunal since the arbitral tribunal becomes functus officio after rendering the award. Similarly, there is no provision under the Arbitration Act that provides for revision of the award, and the only recourse available to a party would be to move the courts to have the award set aside under section 34, in the case of a domestic award, or to raise an objection to enforcement of an award under s 48 of the Arbitration Act, in the case of a foreign award, if the making of the award was induced by fraud, corruption or under other grounds set out in those sections. 👉Despite this, there has been a contrary judicial view on whether a court’s power under s 34 of the Act includes the power to modify or revise an arbitral award. Accordingly, the question at present has been referred to a larger bench of the #SupremeCourt of India for a conclusive decision (Gayatri Balasamy v. CIArb (EAB) YMG 5th Annual Conference 2024: Discussions on Arbitral Award Enforcement in Indonesia Jakarta, Indonesia – On Friday, September 6th, 2024, the Chartered Institute of Arbitrators (East Asia Branch) Young Members Group (CIArb EAB YMG) held its 5th Annual Conference in Jakarta, organized by the Indonesia Chapter. The conference opened with remarks from John Lumbantobing, FCIArb, setting the tone for a day of insightful discussions on arbitration in Indonesia. The event also featured a message from Felda Yeung, Chairlady of CIArb EAB YMG, who highlighted the importance of continuing collaboration between arbitration professionals in East Asia, ensuring the development and harmonization of arbitration practices across the region. One of the key sessions focused on the latest developments and future outlook of arbitral award enforcement in Indonesia, following the introduction of Supreme Court Regulation No. 3 of 2023 (Perma 3/2023). Within the panel on the latest developments and future outlook of arbitral award enforcement in Indonesia, Sri Purnama, a legal researcher from the Legal Lab at Anggraeni & Partners, shared insights from a recent study authored by Setyawati F., Eva Fatimah Fauziah, and Sri Purnama. The study, "Dealing with Unsatisfactory Arbitral Awards: Observing the Grounds of Annulment of Arbitral Awards in Indonesia," was published in the Journal of International Arbitration (Volume 40, Issue 6, 2023).
