About us
The Association of Arbitrators (Southern Africa) NPC ("the Association") was formed in 1979 to constitute an organisation to promote Alternative Dispute Resolution (ADR) as a means of resolving disputes, to provide a body of competent and experienced ADR specialists, i.e. arbitrators, adjudicators, mediators) for appointment as required, to assist ADR specialists in the efficient discharge of their duties, and to make ADR more effective. We appoint Fellows as arbitrators, adjudicators and mediators, either arising from standard commercial contracts (primarily but not limited to the construction industry such as JBCC, NEC, FIDIC and GCC), or by agreement at the request of disputing parties. We facilitate ad hoc arbitrations, as opposed to administered arbitrations, thereby saving costs and avoiding delays. We regularly publish updated ADR rules and model dispute resolution clauses. Our arbitration rules provide for effective, economical and expeditious procedures governing challenges by a party/ies to an appointed arbitrator, or governing arbitral appeals, if so agreed between the parties. We present distance learning in arbitration, adjudication, construction law and mediation. We provide facilities, including state of the art video conferencing facilities to host arbitrations, adjudications, mediations, meetings, training and functions. With branches in the Western Cape and KwaZulu-Natal, we regularly present training and upskilling workshops on various ADR-related topics.
