Dear Sir,
This has reference to subsequent discussions you had with us, we are pleased to award you the
work order for “CONSTRUCTION OF ROADS, DRAINS,CULVERTS, DYKES, TT
PARKING & ALLIED CIVIL WORKS AT IOCL’S PROPOSED DEPOT AT
SEKERKOTE, AGARTALA TRIPURA” AMOUNTING TO Rs. 18,28,05,164/- as per the
following Terms & conditions:
6. Escalation:
No escalation
7. Time Schedule:
The entire work under this scope shall be successfully completed in all respects of 15 months
from the date of issue of work order.
8. INSURANCE:
You shall, at your own cost, ensure your men, materials and machinery as may be needed. You
shall cover your workmen under the workmen’s compensation insurance.
9. LIQUIDATED DAMAGES:
You are liable for a penalty, if our work has been delayed due to the slow progress/ non –
completion of your scope of work on back-to-back basis as per the condition with IOCL.
17. TERMINATION:
SKC reserves its right to withdraw part of the work or full work and get the same done through
alternate means at your risk and cost in the event of your unsatisfactory performance, or if you:
a. do not commence the work in the manner described or do not comply to our Site- In- charges
notices, instructions etc.
b. fail to carry out the work in conformity to the drawings, specifications and contract/
agreement.
c. fail to carry out the work in accordance with the time schedule.
d. fail to carry out work to the satisfaction of our Site Personnel or our Client.
18. DISPUTES:
a. ARBITRATION: In case of any dispute/disputes arising out of this work order, the same
shall be referred and resolved only by way of arbitration in accordance with the provisions of
the Arbitration and Conciliation Act, 1996 by a sole Arbitrator who shall be appointed by the
Managing Director of the company S K Construction and any award or final order passed by
such appointed sole arbitrator shall not be questioned only on the ground that it was passed
by an appointee of the Managing Director acting as sole arbitrator. The procedure to be
adopted for such arbitration proceedings shall be determined by the Sole Arbitrator at his sole
discretion and his decision shall be final and binding on both the parties. The fact that such
sole arbitrator so appointed was in any manner connected with the subject matter of the
dispute shall not be considered as a disqualification for such appointment. The venue of
arbitration shall only be at New Delhi.
b. JURISDICTION: The courts at New Delhi alone shall have the exclusive jurisdiction in
respect of any dispute/disputes arising out of this work order.
