MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:


This Memorandum of Agreement made and entered into by and
between:
The PINGAD NATIONAL HIGH SCHOOL-SENIOR HIGH, a government
entity mandated by laws particularly the 1987 Administrative
Code (EO 292), Batas Pambansa Blg. 232 (Education Act of 1982,
as amended by R.A. No. 9155 (The Governance of Basic Education
Act of 2001), represented herein by GRACE F. BOLINGET, School
Head and BAUDER P. LANGKIA, Senior High Department Head
hereinafter referred to as “FIRST PARTY”

AND

The Parents Teachers Association (PTA) is an accredited


school organization of Pingad NHS-Senior High School, with
office address Camatagan, Sabangan, Mountain Province,
represented herein by its PTA President STEPHEN B. OMAWENG,
hereinafter referred to as “SECOND PARTY”

WITNESSETH

WHEREAS, the Department of Education of the Philippines is the


primary government instrumentality mandated to formulate,
implement, and coordinate policies, plans, programs and
projects in the areas of formal and non-formal basic
education; supervise all elementary and secondary education
institutions, including alternative learning systems, both
public and private; and provide for the establishment and
maintenance of a complete, adequate, and integrated system of
basic education relevant to the goals of national development;
WHEREAS, the Department of Education designed the
implementation of RA 10533 within the framework of increased
community involvement in the learners experience;
WHEREAS, the Department of Education adopted measures to
ensure learning continuity during the COVID 19 pandemic by its
readiness to participate in the progressive expansion of the
face-to-face learning modality as per Deped Memoradum no. 30,
s of 2022;
WHEREAS, the school is mandated to address the teaching and
learning gaps encountered in the distance learning modalities;

and Strengthen the school-community health and safety support
system for all learners as stipulated in the Department of
Education (DepEd)-Department of Health (DOH) Joint Memorandum
Circular (JMC) No. 1, s. 2021, titled, Operational Guidelines
on the Implementation of Face-to-Face Learning Modality;
WHEREAS, the school seeks to seek active support from its
stakeholders, particularly the Parents Teachers Association
for the Basic Learning Continuity to be successful;
NOW THEREFORE, for and in consideration of the foregoing
premises, the parties agree as follows:
SECTION I. Obligations of the First Party
The First Party hereby agrees to undertake the following
responsibilities and obligations:
1. To ensure the compliance of the provisions of the
quality Basic Learning Education Continuity Program to
the students;

2. The school will implement full face to face classes


for the school year 2022-2023; and
3. Ensure the school will comply with the Minimum Public
Health Standards localized guidelines as mitigation
process for its COVID 19 response.

SECTION II. Obligations of the Second Party


The Second Party hereby agrees to undertake the following
responsibilities and obligations:
1. Ensure the participation of children/ students in the
school
2. Cooperate to guide their children to abide with the
minimum health standards and provide necessary
resources
3. Participate in school activities that will enhance
learning of their children such as joining in planning,
reviews and validation and evaluation
4. Actively participation in resource programming through
donations, solicitations and other fund-raising
activities
5. Actively support their children in their home works /
home activities
6. Be in active communication with teachers on the
progress of their children through group chats, mobile
phones, facebook and/or face to face encounters.

7. Develop good work habits, attitudes, appreciation and
respect for each other and for the school as an
institution.
ARTICLE III. AMENDMENT

This Agreement may be amended, modified, revoked, or


terminated by either of the parties, provided that any
amendment or modification of this document or any part
thereof, shall be effective only upon notice and execution of
a written instrument duly signed by both parties within thirty
(30) calendar days prior to the amendment, modification,
revocation or termination.

ARTICLE IV. Effectivity


This Memorandum shall take effect upon signing thereof and
shall continue for a period of 2 years with the option for
renewal at the end of the term unless the parties or any of
the parties decides to terminate the agreement before the term
ends. In case of such termination, the party initiating the
termination shall notify the other party at least one (1)
month from the date of the effectivity of termination without
prejudice to the obligations already incurred. Specifically,
activities that take time to finish and have already been
commenced shall continue until conclusion with due
consideration to the effectivity of the termination as herein
contemplated.

ARTICLE IV. Amicable Settlement

If the other party is a government entity


Any dispute, claim, controversy, or disagreement arising out
of or in connection with this agreement that cannot be settled
amicably within thirty (30) calendar days after written
notice, shall be resolved or adjudicated in accordance with
the provisions of Presidential Decree No. 242, in relation to
Chapter 14, Book IV of Executive Order No.292, otherwise known
as the “Administrative Code of 1987.

Or if the other party is a private entity


Any dispute, claim, controversy, or disagreement arising out
of or in connection with this agreement shall be settled
amicably within thirty (30) calendar days after written
notice.

Schools Division Superintendent of the DepEd Division Office
of Mountain Province, MARCELITA P. MOISES, with office
address at Tambingan, Sabangan, Mountain Province, and
hereinafter referred to as “FIRST PARTY”

The Homeroom Parents Teachers Association (HPTA) is an


accredited school organization of Sabangan National High
School, with office address Sabangan National High School,
Sabangan, Mountain Province, represented herein by its HPTA
President , _____________________ , and hereinafter referred
to as “SECOND PARTY”

WITNESSETH
WHEREAS, the Department of Education of the Philippines is the

responsibilities and obligations:
1. Ensure the participation of children/ students in the
school

Any dispute, claim, controversy, or disagreement arising out


of or in connection with this agreement that cannot be settled

notice, shall be resolved or adjudicated in accordance with
the provisions of Presidential Decree No. 242, in relation to
Chapter 14, Book IV of Executive Order No.292, otherwise known
as the “Administrative Code of 1987.

Or if the other party is a private entity
Any dispute, claim, controversy, or disagreement arising out
of or in connection with this agreement shall be settled

notice.

Sabangan, Mountain Province, represented herein by its Barangay Chairman,
CEDRIC ROMMEL V. LIKIGAN , and hereinafter referred to as “SECOND PARTY”

WITNESSETH
WHEREAS, the Department of Education of the Philippines is the primary
government instrumentality mandated to formulate, implement, and coordinate
policies, plans, programs and projects in the areas of formal and non-formal basic
education; supervise all elementary and secondary education institutions, including
alternative learning systems, both public and private; and provide for the
establishment and maintenance of a complete, adequate, and integrated system of
basic education relevant to the goals of national development;
WHEREAS, the Department of Education designed the implementation of RA 10533

WHEREAS, the school seeks to seek active support from its stakeholders ,
particularly the Tambingan Barangay Local Government Unit , where the school is
located, for the school to implement the basic Educaiona Learning continuity Plan to
be successful;
NOW THEREFORE, for and in consideration of the foregoing premises, the parties
agree as follows:
SECTION I. Obligations of the First Party
The First Party hereby agrees to undertake the following responsibilities and
obligations:
a. Coordinate with the barangay local government unit of Tambingan (BLGU) or
the Barangay Emergency Response team (TBHERT) to ensure that
protocols are properly observed .
b. Operationalize the Preventive Alert System in the school (PASS) for COVID
19 (Per DepEd memorandum no. 15 s, 2020)
c. The school has identified a designated waiting area with proper ventilation
and strict observation of physical distancing for parents/guardians/
chaperones
d. The school will implement full face tp face classes for the 4 th quarter of SY
2021-2022 ; and
e. Ensure the school will comply with the Minimum Public Health Standards
localized guidelines as mitigation process for its COVID 19 response.

SECTION II. Obligations of the Second Party


The Second Party hereby agrees to undertake the following responsibilities and
obligations:
a. acts on referrals / full disclosure of cases of students who are positive of
COVID 19 for further evaluation or referral to a hospital if needed;
b. assist the school in the compliance of identified COVID 19 positive students/
personnel for isolation and for students /personnel with flu-like symptoms for
appropriate action / care to be give;
c. provide necessary support if requested to foster mental health , preventive
measures , counseling services, specialize psych-social support to learners,
teachers and personnel (for those with confirmed COVID19 cases) ;
d. and assist the school in contract tracing and quarantine of close contacts of
confirmed COVID 19 and suspected personnel and learners within the
barangay.

ARTICLE III. AMENDMENT

This Agreement may be amended, modified, revoked, or terminated by either of the
