TEACHER TRADE UNIONISM IN

ZAMBIA
What is a Teacher trade Union?
 A teachers' union is a special type of labor union designed to fight
for the rights of educators.
MAJOR FUNCTIONS

 Teachers' unions are collective bargaining units that represent the


needs of educators to the employer on behalf of the teachers
concerning better salaries and improved conditions of service.
 Advocating for the best possible work environment for teachers.
 Act as middlemen in grievance handling between the employer and
the employee (teacher)
 Provision of worker Education to teachers. E.g policies
FREEDOM OF ASSOCIATION

 In line with Part 3 of Zambian Constitution under freedom of


Association and also espoused by Chapter 269 of the Laws of
Zambia, ALL TEACHERS ARE EXPECTED TO BELONG TO A UNION so
that they are represented if they are to fully enjoy their rights.
CONDITIONS OF SERVICE BARGAINED FOR

The following are some of the conditions of service already


bargained for by the teacher unions:
 Housing Allowance: shall be paid at the rate of 20% of the monthly
basic salary with effect from 1st January 2022 to deserving teachers
not accommodated by the government. For one to qualify, must
consider the following the DEFINITION OF A STANDARD HOUSE
defined as follows:
I. Must be a permanent building
II. Has at least one (1) bedroom, a kitchen, living room and
allocated a toilet
III. Walls made of burnt brick, stone, concrete, asbestos, metal or
processed/treated wood and built by cement mortar for brick,
stone, concrete or prefabricated material.
IV. Floor made of cement, concrete, stone or brick work in cement
mortar.
V. Roof made of non-inflammable material- asbestos, iron sheets,
concrete, metallic or asbestos.
VI. External doors made up of wood, metal or fibre glass or any
other approved material, and
VII. Windows with wood or metal frames with a provision for a glass
panes and each room in the house must have a window.
Employees accommodated in houses belonging to mission agencies,
councils, Parent Teachers Associations and any other house that does
not belong to the Government shall be entitled to receive housing
allowance at the rate of 20% of monthly basic salary.

 Rural and Remote Hardship Allowances, shall continue to be paid


to eligible employees through the payroll as follows:
a.Rural hardship Allowance- 20% of basic salary
b.Remote hardship allowance – 25% of basic salary
The definition of Rural and Remote areas and the Eligibility criteria for
paying Rural and Remote Hardship allowances are as follows:
All the Cities, Municipalities, and Districts are grouped in Category A,B,C,
or D.
The definition of categories are as follows:
a.Urban Area: A station which is not more than 30 kilometers (km)
from the nearest district centre for Category A; 25km for Category B
and 20km for Category C.
b. Rural Station: A station which is between 30 and 70km from the
nearest District Centre for Category A; 25 – 70 km for Category B;
20 – 70 km for Category C and 0- 15 for Category D.
c. Remote Station: A station which is over 70 km from the nearest
district centre for Categories A, B and C and over 15 km for Category
D.
d. In addition to the criteria above, placement in Categories A,.B,C
and D is also dependent on the following:
i. Accessibility to banking facilities
ii. Accessibility to licensed outlets to buy basic items and services
iii. Accessibility to clean and safe water
iv. Accessibility to electricity
v. Accessibility to post office and postal services
Any District without any of the facilities above is placed in Category D.
NOTE: it should be emphasized that for the purpose this definition,
DISTANCE means the distance from the nearest district centre and not
necessarily the administrative district where the station belongs.
 Transport Allowance paid at 10%
 Meal Allowance paid at K100.00 when working away from work
place in a day
 Daily Subsistence Allowance paid at different rates when you are
working away from work place for a day and number of days.
 Leave Travel Benefits when you go on Vacation leave of more than
30 days
 Repatriation Allowance when you retire from work
 Better Salaries bargained for every year. For 2022, the basic salaries
were increased by 12% with effect from 1st January 2022.
 Settling in Allowance shall continue being paid at single rate of
twenty five (25%) per cent of annual basic salary through the
payroll.
 Responsibility Allowance: paid at the rate of 20% of basic salary
and is paid on 12 monthly cycle. Eligible teacher should re- apply
fot this allowance each November to facilitate for inputs on the
payroll for January of the following year and allow eligibility
verification to be undertaken.
The following will be eligible:
i. Degree holder teacher ‘A’ Level class
ii. Advanced Diploma holder teaching either senior or ‘A’ Level
classes at a Secondary School.
iii. Diploma holder teaching senior classes.
NOTE TOO: That number of period one is teaching to be eligible for the
allowance is not a factor.

 Double class allowance: to be paid to at the rate of 20% of basic


salary and is paid on 12 monthly cycle. Eligible teacher should re-
apply for this allowance each November to facilitate for inputs on
the payroll for January of the following year and allow eligibility
verification to be undertaken.
The following shall be used to as criteria for teachers to qualify for
double class allowance:
i. Teacher s who are teaching two or more classes of the same or
different grades at lower primary at different time periods i.e .
(from Grade 1 to 4) are eligible to receive Double class
allowance
ii. Teachers teaching combined Grades and Multi Grades are not
eligible to to Double class Allowance such as Grades 3A and 3B
and Grades 3 and 4 combined, respectively;
iii. Teachers in School Management i.e. Head Teacher, Deputy
Head Teacher, and Senior Teachers.

 Paternity leave: shall be 10 calendar days (week end


inclusively) to be taken once every two (2) years on
production of a record of birth of the child duly signed
and issued by a registered Health Practitioner.
 Maternity leave: shall be administered in accordance to
with the provisions of the Employment Act No 3 of 2019.
GRIEVANCE HANDLING
When a teacher, Administrator feel agitated due to some
misunderstanding between the two people, the agitated person
will not take law in his/her own hands but do the following:
1. Talk to the erring teacher as supervisor or involve the
Union representative if the cause is the supervisor
2. After this, follow the government laid down procedures in
handling cases if it calls for disciplinary measures.
3. Stone throwing unionism is long gone and even it’s
memorial service is forgotten.
