Fiscal: We present our ___ witness in the person of Cardo Dalisay.
Court: Alright, swear in the witness. Court Interpreter: Do you swear to tell the truth, the whole truth and nothing but the truth to this Honorable Court? Witness: Yes, ma’am. Court Interpreter: Please state your name, age, and other circumstances. Witness: Cardo Dalisay, 35 years old, single, Police Investigator at Bantay Police Station, Bantay, Ilocos Sur and a resident of Brgy. Balaleng, Bantay, Ilocos Sur. Fiscal: Your honor, we offer the testimony of the witness to prove that he conducted an investigation on the incident. May we proceed your honor? Court: Proceed. Direct Examination Question: Mister Witness, since you claimed awhile ago that you are a police officer, when did you join the PNP as a police officer? Witness: December 16, 2010 when I joined the PNP ma’am. Q: On July 31, 2020 where were you at that time? A: I was in the PNP station of Bantay, Ilocos Sur ma’am. Q: Do you recall any incident that happened related to this case that happened on July 31, 2020? A: Yes ma’am. At 3:30 p.m., Crisencia M. Manzano came to our station and reported a vehicular accident that happened 13 days ago along Bantay National Highway, Bantay Ilocos Sur. Q: What did you do after Crisencia M. Manzano reported the vehicular accident? A: I immediately proceeded to the place of the reported vehicular accident ma’am. Q: What have you noticed on the place where the accident happened? A: The scene of the accident was already clear ma’am. Q: What did you do next if there is any? A: Since the place where the accident happened is already clear, I proceeded to the places where the vehicles were situated, took picture of it to assess the damages and interviewed eye witnesses. Q: What information have you gathered from your investigation? A: Based on my investigation, I have gathered that both drivers have no driver’s license at the time of the accident and that the driver of the electric bike eventually died. Q: Have you gathered any information on what caused the said vehicular accident? A: Based on my investigation, the electric bike that was driven by the deceased Mariano Manzano was traversing the National Road along Bantay, Ilocos Sur when suddenly the Tricycle of Isaac Cruz crossed the highway causing the electric bike to bump into the left front part of the tricycle which resulted to the injuries sustain by Mariano Manzano. Q: After you have investigated on the matter, what else have you done? A: I entered the Incident in our police blotter record book ma’am. Fiscal: No further questions your honor. Defense Counsel: May we proceed to cross-examination your honor? Court: Proceed Atty Tengco Question: Do you agree with me mister witness that this incident transpired on July 17, 2020? Answer: Yes ma’am. Q: And on July 17, 2020 you did not receive any report regarding this incident? A: Yes ma’am Q: In fact, it was only on July 31, 2020 where that you first learned about this vehicular accident, Mr. Witness? A: Yes ma’am. Q: Do you recall who reported the incident on July 31, 2020 to the police station Mr. Witness? A: It was Crisencia Manzano, ma’am. Q: Do you recall if she was accompanied by any person at the time she reported on July 31, 2020? A: Yes ma’am. Q: Were you able to know who were those who accompanied Crisencia Manzano, Mr. Witness? A: Her daughter ma’am, but I do not know her name. Q: To refresh your mind maybe you remember the name Robin Dasalla as one of the companions of Crisencia Manzano? A: Yes, ma’am, he was the one who narrated the facts regarding the incident. Q: Do you confirm now that it was not Julita Santos who narrated the circumstances leading to the filing of this Reckless Imprudence, correct? A: Yes ma’am Q: Did you ask if he was able to witness the actual happening of the vehicular accident? A: No ma’am Q: You just entered into your blotter about the circumstances that was narrated by Robin Dasalla, correct? A: Yes ma’am, but Julita Santos confirmed it. Q: Based on your investigation, was there an actual witness to the incident? A: Yes ma’am, it was Julita Santos. Q: And you took photographs several weeks after the incident, correct? A: Yes, ma’am Q: Do you agree with me Mr. Witness that those motorcycles involved and the damages that you have seen at the time you went to take photographs could be possibly done or caused by another incident? (Objection of Fiscal optional) A: It is possible ma’am. Atty Tengco: That would be all your honor.
