I just finished listening to another talk about the backlash. Once again, I heard comments about how we need to double down on current efforts, argue for the "business case for diversity," work on making individuals behave better, and focus on broader societal issues of fairness and justice. At the cost of upsetting some of my DEI colleagues, this is just the wrong thing to do. If something has not worked, doubling down has never been a sound strategy—especially when some of the things on which you double down are the heart of what caused backlash in the first place. Throwback to the origins of RSI's Trust Project! RSI recently ran across this fascinating 2021 video of Ava Abramowitz and Ken Webb discussing the potential for behavioral analysis to be applied to mediation. The conversation is expertly led by Michael Lang as part of his In Their Voices project. Here's Ava talking about the goal of applying behavioral analysis to mediation, from the video: "What I would like to do is unleash the benefits of, power of, mediation so that disputants can make maximum use of it. And to be able to do that — given the fact that research money is so slight in the United States of America — if we could all agree on something, we could start building on each other's research so that we kept on enhancing and emboldening and broadening what we know. "So the hope is is that we provide a methodology and a mechanism that would be available to all researchers so they can build on each other's research." RSI's Trust Project, which Ava and Ken are integral to, is now exploring the effects of mediator behavior on party trust, using behavioral analysis! "Small Great Things" by Jodi Picoult : Get the book @ www.vintagevaluebooks.in "Small Great Things" by Jodi Picoult is a powerful and thought-provoking novel that explores the complex issues of race, prejudice, and the justice system. The story follows the life of Ruth Jefferson, an experienced African American labour and delivery nurse, who finds herself at the centre of a shocking racial controversy. The novel opens with Ruth being assigned to care for the newborn infant of a white supremacist couple, who expressly forbid her from touching their child. However, when the infant goes into cardiac distress, Ruth is forced to make a split-second decision that will change the course of their lives forever. As the story unfolds, we are drawn into a gripping legal battle, where Ruth is charged with a crime for simply doing her job. Picoult masterfully builds the suspense, taking readers through the emotional rollercoaster of the trial proceedings. We witness Ruth's struggles to maintain her composure in the face of blatant racism and discrimination, wondering if she will be able to overcome the odds and clear her name. One particularly poignant moment comes when Ruth reflects on the harsh realities of being a Black woman in America, saying, "Sometimes it feels like the air around me is thick with expectations, like I'm swimming through molasses just to get through the day." These powerful words encapsulate the ever-present burden of systemic racism that Ruth and so many others face. Ultimately, "Small Great Things" is a complex and nuanced exploration of the human condition, challenging readers to confront their own biases and preconceptions. Picoult masterfully weaves together the personal and the political, crafting a gripping narrative that will stay with you long after the final page.

Empowering Resilience: Insights from the CLA Conference Keynote Address As the keynote speaker at the CLA Conference in Jamaica for the esteemed Supreme Court Judges of the State of Louisiana, I felt a surge of excitement as I commenced the conference proceedings preceding the US elections. The event was rich with critical discussions, presentations, debates, and resolutions.
