Another important aspect of the current flurry related to involuntary treatment. People assume that it’s only used on people who are assessed as incapable of making their own health care decisions. Not true. The current law in BC has *no requirement to assess a persons capacity or find them incapable* before making them an involuntary patient, detaining them, or administering treatment by physical force. And, unlike *every other adult* recieving health care in BC, the people who know us best or who we choose to make decisions if we are unable to make them, are legally excluded from decision-making under BC’s current involuntary treatment law. No other province in Canada (or place in the world as far as I’m aware) takes this approach.
BC’s “deemed consent” laws mean that anyone can be made an involuntary patient, and all involuntary patients are “deemed” to consent to any form of psychiatric treatment the doctor chooses. For involuntary patients under BC’s Mental Health Act, there are no requirements to assess whether a person can make their own treatment decisions, to ask the person for consent, or to involve loved ones like the person’s family members or friends. Those who are being involuntarily treated should have the choice to involve those who know them best in their treatment. Mental illnesses are the leading causes of disability worldwide. Psychotic disorders occur in about 3% of people in the general population during their lifetimes. Patients experiencing acute psychosis need a medical provider who is capable of differentiating among medical, drug-induced, and psychiatric causes of the presentation to initiate the most appropriate management plan.
