Having acted for the successful respondent, Black Swan Petroleum (BSP), Oliver Caplin KC brings a first-hand perspective to this week’s discussion! The case itself involved a rare form of anti-suit injunction – an anti-anti-arbitration injunction’ (AAAI), which was designed to require BSP to discharge an anti-arbitration injunction that it had obtained from the High Court of Malaysia, which restrained Euronav’s prosecution of a London-seated LMAA arbitration. What an awesome day in Madrid ! Catching up with an old dear friend - that’s you Sheffs (Sara Sheffield), who as Co-Chair of the Asset Recovery Committee helped pull off a wonderful IBA event. And I made plenty of new friends too… Presented on a specialist panel in the morning, led by Dorothy Siron as moderator, with other speakers, Tara Archer-Glasgow, Marco Remiorz, Elina Nikolaidou and Jessica Thorpe. You all did a brilliant job. Then to top it off, we enjoyed dinner at the grand Casino de Madrid ! It was a touching heartfelt speech, Tomislav Sunjka, as Co-Chair. Oh and managed to squeeze in a quick look at the Estadio Santiago Bernabéu…

Updated Earlier today, President Yoon Suk Yeol of South Korea declared martial law. Less than two hours later, South Korea's parliament voted it down and ruled the declaration invalid. Soon thereafter, #SouthKorea's President backed away and announced he would lift martial law. With political instability such as this, there can be wide reaching impacts throughout South Korea's #maritime industry and infrastructure, and could lead to port congestion, increased customs delays and potential prohibitions on the entry or exit of certain vessels and goods to and from South Korean ports, as well as disruption at South Korean shipyards. #VesselBuyers, #Owners and #Charterers should carefully review the provisions of their South Korean shipbuilding contracts, MOAs and charterparties, as sovereign action is often included in force majeure, laytime/demurrage exclusion and permissible delay clauses.
