📢Judgement The UK Supreme Court handed down judgment on 13 November 2024 in FIMBank Plc v KCH Shipping Co Ltd, holding that the time bar in article III rule 6 of the Hague and the Hague-Visby Rules applies in relation to claims for misdelivery occurring after discharge, as well as to other breaches of duty by the carrier occurring after discharge and before delivery. In doing so, the court rejected the notion that the application of the time bar was limited to a “period of responsibility” between the commencement of loading and the completion of discharge. The Supreme Court’s decision resolves an important question which had not previously been decided by the English courts, and which has divided leading academic commentators as well as judges in other common law jurisdictions. 📢Judgment The High Court has ruled in favour of a respondent charterer seeking that the proceeds from the sale of a shipment of naphtha, held due to OFAC sanctions, should be paid to the court, pending the tribunal’s award in a related arbitration. The applicant shipowner contended that paying funds to the court would breach OFAC sanctions and thus put itself and its personnel at risk of prosecution. The judge found that the risk of prosecution on these grounds was “fanciful” rather than “real”, and thus that the cargo sale proceeds should be paid to the court rather than a ‘blocked account’. Moreover, he found that the importance of making payment into court in this instance would have outweighed the risk of prosecution, even if that risk was found to be ‘real’.
