The Svea Court of Appeal has ruled that an SCC Arbitration Institute tribunal lacks jurisdiction to keep hearing an investor-state case against Georgia over the forced sale of a tobacco business, as the most-favoured nation clause of the investment treaty did not enable the parties to substitute the designated arbitral institution, ICSID, with another.
