Here's a further extension and a RESTRICTION The Nigeria Data Protection Commission- NDPC has further extended the time for organisations and individuals to register as Data Controller/Data Processor of Major Importance. This time around, it followed with restrictions on data processors. Here, data controllers are to deal with ONLY registered data processors. You are a data processor if you are engaged by an organisation to process clients/customers personal data on their behalf. Mostly, third parties and vendors made up this category. Example: 1. A payment gateway service provider processing financial details of customers to help customers make payments. 2. A mailing company that assist another company send emails or SMS to customers. ********************************************" It may seem like another DIY but you need to hear my recent encounter. 👇🏽👇🏽 * * * I had a hard time telling a Client to hold on and allow me handle their registration because I noticed a glitch in the network. The client went ahead to pay it personally. This it is almost day 10 since that happened. (it's usually approved with 3 - 7 days max) Yet, the application still shows pending. This person will still run back to ask me to resolve it. As a dispute resolution lawyer at Gadell Law Practice, I recently participated in mediation skills training by the Lagos State Multi-Door Courthouse. Avoid These Common Pitfalls When Registering with the Nigerian Data Protection Commission. 🙅 If you are looking to register as a data controller or data processor of major importance, be mindful of these key requirements to prevent your application from being queried: 1. Lack of a Certified Data Protection Officer: The NDPC requires a certified Data Protection Officer (DPO) to validate your registration. A certified DPO is one with recognised training in data protection. Heads-up: You will need to upload a certification for verification. 2. Incorrect Classification Level: The NDPC categorizes data processing into three levels: Ultra-High, Extra-High, and Ordinary High. Registering under the wrong classification may lead to a query. The NDPA in its interpretation section- Section 65 defines sensitive personal data Sensitive personal data includes details about genetic and biometric data, race, religion, health, sex life, political views, trade union memberships, and any other information designated as sensitive by the Commission. Section 30 of the Nigerian Data Protection Act, 2023, permits processing sensitive personal data only under nine specific exceptions. 1. Explicit Consent The data subject (the person whose data is being processed) must have given clear and informed consent for the specific purpose of processing their sensitive data, and this consent must not be withdrawn. Eg: You give explicit consent for your health data to be used by a medical research organization for a particular study. 2. Public Health Necessity Processing is necessary for public health reasons and must include appropriate measures to protect the rights and interests of the data subject. E.g.: Processing health data for a public health campaign, with safeguards to protect individual privacy. 3. Archiving, Research, or Historical Purposes Processing is necessary for archiving in the public interest, or for historical, statistical, or scientific research, based on a law that's proportionate to the aim and includes measures to protect the data subject's rights. E.g.: Using historical data for research, where the law ensures privacy protections. 4. Employment or Social Security Laws Processing is necessary to comply with employment or social security laws or similar regulations. E.g. Handling sensitive data related to employee health for compliance with workplace safety regulations. 5. Vital Interests Processing is necessary to protect the vital interests of the data subject or another person when the data subject cannot give consent. E.g.: Using sensitive data in a medical emergency where the individual is incapacitated. 6. Non-Profit Organizations Processing is conducted by non-profit organizations for their legitimate purposes, with safeguards in place, and is limited to members or people with regular contact with the organization. E.g.: A charity processing sensitive data of its members for internal purposes, without sharing it outside the organization. 7. Legal Claims Processing is necessary for the establishment, exercise, or defense of legal claims, obtaining legal advice, or conducting legal proceedings. E.g.: Using sensitive data in a legal case to support a claim or defense. 8. Substantial Public Interest Processing is necessary for substantial public interest based on law, with measures to protect the data subject's rights. E.g.: Using sensitive data for a public policy initiative with legal and privacy safeguards. 9.
