    COMES NOW, Jan M. Bennetts, Ada County Prosecuting Attorney, and moves this
    Court that the case of State of Idaho v. AMMON EDWARD BUNDY, in which a formal
    complaint was filed on or about the 15th day of January 2021, for the crimes of: I.
    TRESPASSING, MISDEMEANOR, I.C. §§ 18-7008(2)(a), (3)(b)(i) and II. RESISTING
    AND/OR OBSTRUCTING AN OFFICER, MISDEMEANOR, I.C. §18-705, be dismissed.
    The State moves to dismiss the charges in case number CR01-20-33897, and only in this
    case. The State intends to proceed on the charges in Defendant’s case number CR01-20-34189.
    The State has, within the last two business days, come into possession of additional evidence in
    the case. Said evidence was received after business hours on March 3, 2021. Such evidence was
    formally disclosed to Mr. Bundy on March 5, 2021. The State conducted additional necessary
    investigation into the matter on March 4 and March 5, 2021. Upon full consideration of the

    matter, including the new evidence and the investigations thereof, and in light of the change in
    the complexion of the State’s case, the State moves to dismiss the above-named case in the
    interests of justice.
    The above-mentioned new information has no relationship to the August 25, 2020
    incidents and the State intends to proceed with the charges related to August 25, 2020 as
    scheduled in Defendant’s case number CR01-20-34189.
