BARANGAY ORDINANCE NO. 1 S. 2018

AN ORDINANCE PROHIBITING GAMBLING AND OTHER ILLEGAL GAMING IN BARANGAY AYAT,

MANDAON, MASBATE, AND IMPOSING PENALTIES THERETO AND FOR OTHER PURPOSES.

BE IT ORDAINED by the 9th Sangguniang Bayan of Barangay Ayat, Mandaon, Masbate on

its 2nd Regular Session held at the Barangay Session Hall on July 17, 2018 at 1:00 P.M.

Section 1.- Title – This ordinance shall be known as “ ANTI GAMBLING AND ILLEGAL GAMING
ORDINANCE” of the Barangay Ayat, Mandaon, Masbate.

Section 2. – Purpose – The purpose of this ordinance is to prohibit gambling and illegal gaming
from proliferating in the Barangay as these acts are inimical to the welfare or morals of the people
of the community and greatly influence the individual’s disregard for the value of dignified work,
perseverance and thrift. This ordinance is enacted to comply with the provisions of RA 9287
amending Presidential Decree No 1602 and all other pertinent rules and regulations regarding
illegal gambling and illegal numbers games under different Memorandum Orders of concerned
national government agencies.

Section 3. – Definition of Terms- For the purpose of this Ordinance the following terms shall
mean:

1. Card games – are games that involve the use of playing cards or “inipis” such as but
not limited to black jack, lucky nine, “pusoy” or Russian Poker, tong-its, beat game
and the like.
2. Tupada – a form of village based cockfight usually held at a benefit game or beneficio
not during village celebration.

Section 4. General Prohibition on gambling – It shall be unlawful for any person to participate
directly or indirectly in any game scheme or activity that involves placing money or any article of
value as bets and where winning is dependent upon luck, skill or both.

Section 5. Prohibited Acts - the following acts of gambling or illegal gaming are prohibited:
tupada, card games, palk que, domino, mah-jong, high and low, bookies or jai alai or horse racing
that usually involves game fixing and other lotteries, drop ball, car racing, roulette, slot machines,
dog racing, dice games and other races, point shaving and other machinations, banking on
percentage game, or any game scheme, whether upon chance or skill, which do not have a
franchise from the national government, wherein wagers consisting of money or articles of value
are made.

Section 6. Exemptions - In accordance with existing laws, gambling may be allowed provided
these are covered by franchises from the national government; authorized or licensed by
government agencies duly empowered by law or their charters to license or authorize the conduct
of such games or activities or is conducted in a manner that does not violate the terms and
conditions duly prescribed by said government agencies.

Section 7. Penalties – Any person who violates the provisions of this Ordinance shall be fined as
follows:
First Offense – Php 300.00
Second Offense - Php 500.00
Third Offense and succeeding Offenses: 1000.00 or imprisonment of not less than
(3) months and not more than (6) months, or both such fine and imprisonment, at the discretion
of the court.

Section 7. Implementation – The Philippine National Police shall issue the necessary citation
tickets to violators of this Ordinance. Fines shall be paid Barangay Treasury based on the citation
tickets submitted by the PNP.

Section 9. Reparability Clause – If, for any reason, any provision, section, part or parts of this
ordinance is declared not valid by a Court of Competent Jurisdiction or suspected or revoked by
authorities concerned, such judgement shall not affect or impair the remaining provisions,
sections or parts which shall continue to be in force and effect.

Section 10. Repealing Clause – All existing ordinances, rules and regulations inconsistent with the
provisions of this ordinance are hereby repealed or modified accordingly.

Section 10. Effectivity – This ordinance shall take effect upon approval and upon compliance with
the posting and publication requirements.

1. No person shall allow any form of gambling mentioned and embraced in the preceding
section to be conducted or carried on in any real property that he owns or under his
administration and control.

2. No person shall participate, directly or indirectly, in any gambling referred to in Section 1

thereof.

3. No person shall posses any ticket, paper or matter containing letters, figures, signs or symbols
which pertains to or are connected with the game of “jueteng”, “masiao”, “swertres, or similar
games prohibited herein, nor posses cards, chips and other gambling paraphernalia, which have
been used or about to be used, in any illegal gambling mentioned herein. Mere possession of
those things before, during and immediately after the conduct of such illegal gambling shall be
considered as a “prima facie” evidence for the purpose of this ordinance.

SECTION III – EXEMPTIONS – Conduct or holding of “BINGO SOCIALS”, “POPULARITY CONTEST”,

OR “RAFFLES” and similar fund raising activities are exempted from the provisions of this
ordinance, provided, that a permit thereof has been secured from ANY AUTHORIZED AGENCY
TO ISSUE PERMIT and when said activities shall be undertaken within the territorial jurisdiction
of the concerned barangay.

SECTION IV – APPLICABILITY CLAUSE – All other matters pertaining to illegal gambling not herein
specified shall be covered by the provisions of existing laws, ordinances, rules and regulations.

SECTION V – PENALTY – Any person who violates any provision of this ordinance shall be
punished by a fine of not more than two thousand five hundred pesos (P2,500.00) or
imprisonment of not more than six (6) months, or both such fine and imprisonment, at the
discretion of the court without prejudice to the imposition of a higher penalty under the
provision of existing laws.

SECTION VI-EFFECTIVITY -This ordinance shall take effect after all Sangguniang Barangay, and
Punong Barangay approved this.
