AN ORDINANCE PROHIBITING STORES TO SELL INTOXICATING DRINKS


AND CIGARETTE TO MINORS

--------------------------------------------------------------------------------------------WHEREAS, Section 13 of the 1987 Constitution provides that the State recognizes
the vital role of the youth in nation-building and shall promote and protect their
physical, moral, spiritual, intellectual, and social well-being. It shall inculcate in the
youth patriotism and nationalism, and encourage their involvement in public and
civic affairs;
WHEREAS, Title V Chapter III of City Ordinance No. 11 Series of 2013 sets a
prohibition on stores to sell intoxicating drinks or cigarette to Minors;
NOW THEREFORE, on motion of Hon. Pedro G. Lacap, be it;
RESOLVED, as it is hereby RESOLVED, to enact this ORDINANCE;

Section 1- Title- this ordinance shall be referred to as AN ORDINANCE


PROHIBITING STORES TO SELL INTOXICATING DRINKS AND CIGARETTE TO
MINORS.
Section 2- Purpose - This Ordinance aims to protect the children of this
Barangay towards the pernicious effects of intoxicating drinks and cigarette in the
development of children in consonance with the states principle of Parens Patriae.
Section 3- Regulated and Prohibited Actsa.) No owner/operator of shopping malls, department stores, sari-sari stores,
tobacco/cigarette/cigar and liquor shops, bars, cigarette vendor and peddler,
or any person who has possession of tobacco products such as but not
limited to cigars and cigarettes, liquor and intoxicating drink to any person
who is below eighteen (18) years of age;
b.) No person shall give for free any kind of cigarette or tobacco products, liquor
or intoxicating drink to minors;
c.) No person shall command/request a minor on errand to buy any cigarette or
any other tobacco product or liquor or intoxicating drink;
d.) No owner/operator of shopping malls, department stores sari-sari stores shall
assign their minor employees to sell or deliver to customers any kind of
cigarette or tobacco product or liquor or intoxicating drink;
e.) All owners/operators of shopping malls, department stores or sari-sari stores
that sell any kind of cigarette or tobacco product or liquor or intoxicating
drink shall post on a conspicuous place of their establishments/stores a
notice to the effect that tobacco cigarettes or any tobacco product or liquor
or intoxicating drinks are not for sale to minors and indicating in that notice
the number of this ordinance;

Section 4- Penalty Clause - Persons caught violation of the aforementioned


provision shall bear the penalty of:
a.) reprimand/warning

d.) Php 1,000.00 -------------------------------------------------------------------4th and succeeding Offenses
In case the violator is a juridical person, the owner, proprietor, manager or
person charged with the operation or management of said entity shall be
responsible hereof;
Section 5- Separability Clause- If any part of this ordinance shall be declared
invalid by Sangguniang Panlungsod, such judgment shall not effect, impair or
invalidate the remainder of ordinance and shall be confined in its operation to the
clause, sentence, paragraph, section or part thereof directly involved in the
question.

Section 6- Applicability Clause All other matters relating to the enactment


of this Ordinance shall be governed by the pertinent laws and other city ordinances.
Provision of Republic Act 7160, otherwise known as the Local Government Code of
1991, Section 511, shall be strictly observed.

Section 7- Effectivity- This ordinance shall take immediately.

ENACTED AND APPROVED this 16th day of October, 2014.
