God has placed so many incredible entrepreneurs in my life, it is joyful to watch them succeed! To have watched Dr. Lovie Negrin APRN, FNP, AGACNP clinical research business experience a 200% growth in under two years is nothing short of amazing! She is a tenacious entrepreneur who understands that in order to move out of the day-to-day she must hire a team. When we first started to document her processes in 2022 her business had four team members, which included one Principle Investigator. This week, while facilitating a session to update her org charts (current and future state) we realized that she now has 12 team members, which includes 5 Principle Investigators. How is she able to support such rapid growth? Welp, first she clearly and effectively communicates the vision for her company, Randomize Now, and then hires the right people for the right positions providing them with the tools and resources needed to execute the vision efficiently and effectively. SAWS raising its ugly head again... From this former Quality Assurance Specialist's (QAS) POV, if the PTAB determined that a particular patent issued in error because the examiner improperly withdrew a proper 103 rejection or failed to properly apply concepts on inherency that would have maintained a proper 102 rejection, then the examiner/art unit should be informed of these examination errors. OPLA and TC management should review their training materials to determine if these concepts are properly covered. QAS should review applications in the similar technology to see if other examiners are making these same mistakes. With review, mentoring and training, examiners and SPEs would learn how to make and maintain proper rejections so that claims, if allowed, would not "weaken the strength and reliability of the patent system." The USPTO does not choose to "close the loop" this way. Instead, read this BS, it reeks of SAWS: "The USPTO also ensures that feedback and input from the PTAB proceedings are used to improve examination of related patent applications. For example, patent examiners are made aware of petitions and outcomes in AIA proceedings so that the evidence and the PTAB’s findings can be considered in ongoing prosecution of related patent applications." Easiest thing in the world for an examiner to cut and paste a PTAB finding into their office actions. The USPTO is using PTAB decisions to target pending applications and specific applicants, to ensure that entire portfolios are killed. SAWS = Sensitive Application Warning System. This won’t go over or age well with inventors, patent holders, investors backing patented companies and small businesses with patents fighting in PTAB. You can’t make this up. Unbelievable what is in this writing from the outgoing Director. It’s a “ in your face” face slap editorial. At the advice of my legal team, and because we’re involved in a pending and expensive PTAB case decision, I can’t make a comment for common sense reasons, …..BUT you can.
