For those who have been looking for a clear and simple explanation of how website cookies and tags work, check out the New York AG's newest privacy guides. For those maintaining websites, take note that while New York does not have a comprehensive consumer state privacy law (yet), the AG is unambiguously signaling that it will leverage its consumer protection laws to protect New York consumers from misconfigured tag and consent management platforms and misleading cookie banners. It is a good reminder to review your cookie banners and the configuration of your tag and consent management platforms! https://lnkd.in/ewsc4qRw #TeamOrrick #Privacy #Adtech

Is your company employing dark patterns? The latest enforcement advisory from the California Privacy Protection Agency (CPPA) (https://lnkd.in/gkU6v2FE) highlights a critical issue: the use of dark patterns in cookie banners and "do not sell or share my personal information" options. Dark patterns are design tactics used to manipulate user choices—often making it harder for consumers to exercise their privacy rights. This practice is particularly prevalent in cookie consent notices, where users are nudged towards accepting all cookies by default, or in complex opt-out processes that make it difficult to protect personal data. Given the CPPA's focus on curbing these deceptive practices, now is the time for businesses to evaluate their privacy interfaces and ensure transparency. Your customers deserve clear, easy-to-understand options when it comes to their data. Are your privacy practices compliant, or are you unknowingly deploying dark patterns? It’s time for a closer look. #DataPrivacy #DarkPatterns #CPRA #DataGovernance #UserRightshighlights

📢 PSA To my fellow marketers: New privacy laws are dramatically changing the digital media game, yet again. I swear, every time we find our stride they change the rules. I **personally** applaud more privacy in our full-frontal, tell all, show all, share all, media landscape. Tracking has gone WAY. TOO. FAR. I **professionally** shake my fist in the air screaming, "Damn you, Google and government for consistently making our jobs soooo difficult!" Best wishes the in-house marketing teams managing their own digital media campaigns. Never forget, we're just a click away when you're ready to cut bait 😋 #hyfyve #missiondriven #digitalmedia

🔒 Concerns over consumer privacy are mounting in Australia, as new research reveals a significant lack of understanding among consumers about how companies track, target, and profile them. The complexity of privacy terms businesses are using only adds to the confusion. Many consumers struggle to comprehend terms like "hashed email address" or "advertising ID", making it challenging to assess how their data is being utilised. The Australian Privacy Foundation dives into how businesses are using our data to make more money (from charging more to preventing you from seeing better offers) and consumer perception. #ConsumerPrivacy #DataProtection #PrivacyReform

I hope you find this article helpful. Consent banners alone are insufficient to protect your customers' privacy or your company's policies. Our recent study found that the vast majority of websites we analyzed faced significant issues with their notice and consent not working as intended. Regardless, we’re all under a microscope and need way better visibility and control than what most companies have today. Looking forward to your comments and feedback! #dataprivacy #privacyregulations https://lnkd.in/gaT-B3ku
