🔒🗞With tech regulation back in the news, it’s a good time to revisit our article on last year’s U.S. Executive Order on Artificial Intelligence. This landmark directive set a new course for businesses navigating the AI landscape, establishing guidelines for AI privacy, governance, and compliance. With the global AI market expected to reach a value of $6 trillion by 2026, the order clarified some of the questions that any company looking to add AI to its workflow will have to address. 🗣“If an organization is going to partner with an AI company, they’re going to want to partner with a company that has a robust compliance program,” said Adam Rivera, Chief Legal Officer at Inbenta. “Does the AI company have a team to support compliance? Do they have a privacy program? Are they thinking about AI governance as their product teams innovate?" “Ultimately, it’s about standing up for consumers to ensure the technology is being used safely and securely,” Rivera said. 🤝🌐 👉 Read the full article here: https://lnkd.in/e4HqeV8G #AI #ArtificialIntelligence #BusinessGrowth #Innovation #USExecutiveOrder #Inbenta

I was asked recently about some of the challenges of AI when it comes to competition enforcement and investigations. Here’s what I think companies will need to be aware of..... 1️⃣ They need to think about privacy concerns. Because using AI to collect and analyse sensitive company data might raise privacy issues. Strict adherence to data protection regulations and ethical considerations are required. 2️⃣ They should consider legal limitations. AI applications need to operate within legal frameworks, including competition laws and data protection regulations, necessitating continuous monitoring and adaptation to ensure compliance. 3️⃣ I would also say they need to think about any ethical issues too. After all, bias in AI algorithms may lead to unfair treatment of certain companies or sectors, making it essential to implement transparent and accountable processes when deploying AI technologies. More on this in my next post tomorrow… watch this space! 👀 #dataprivacy #ai #investigations #regulation #compliance #competitionenforcement

Thinking about incorporating artificial intelligence (AI) into your legal practice? It's 2024, and AI is revolutionizing the legal landscape. But before you dive in, consider both the benefits and risks. Tip: Don't rely too heavily on AI. While it's a valuable tool, it can't replace your professional responsibilities. Remember your duty of competency. Case in point: Lawyers disciplined for submitting AI-generated briefs with fake information. AI chatbots are useful for research, but always double-check their accuracy, just like you would with any other source. Also, consider data privacy and client confidentiality. AI systems often store user data, potentially compromising privileged information. Rule 1.6 of the Minnesota Rules of Professional Conduct applies here—be cautious about what you share with AI tools. Here is our latest Client Alert on DOJ's updated Evaluation of Corporate Compliance Programs guidance.
The Department of Justice’s ("DOJ") Criminal Division announced significant changes to its Evaluation of Corporate Compliance Programs (“ECCP”), which prosecutors use in assessing the effectiveness of corporate compliance programs. The updates to the ECCP cover a range of compliance topics, but most notably focus on steps companies should be considering to mitigate the increasing risks of artificial intelligence (“AI”) and other new technologies. The DOJ continues to raise the bar for corporate compliance programs. Companies should take particular note of DOJ’s comments about AI, access to data, and “speak up” culture.
