We're now at an inflection point in the #healthplan / #healthinsurance #industry and the #healthcaredelivery system. Three days ago, Senators Warren, Markey, Auchincloss, and thirteen (13) House Members urged the #sec to open an #insidertradinginvestigation into #unitedhealthgroup executives’ stock trading activities. Some observations and take-aways from the attached article: 1) Based on Mr. Witty's testimony, it's apparent that he and #uhg's #corporatelegalcounsel have been preparing for his testimony for several days (if not weeks). It would not be surprising (to learn down-the-road) that external #legalcounsel was also involved in Mr. Witty's preparatory work for participating in the senate and house hearings. 2) Federal legislation is coming. It will be interesting to see how this plays out in both chambers of #congress and who will be defending the industry during committee hearings and eventually debate on the floors of congress and #senate. 3) We're quickly reaching the point of 3 months post breach and #unitedhealth and #optum are still getting a handle on the magnitude and severity of this breach. Per Mr. Witty, he "estimated that the #databreach could affect about one-third of all Americans — which would be more than 100 million people — though he said the number was uncertain." 4) Per Mr. Witty, "Change Healthcare’s footprint was the same as it was before UnitedHealth acquired it in 2022. And health sector security experts argue that it would have been far harder to do if the companies’ technology systems were more integrated than they are today, just 16 months into the acquisition." I find this interesting as it raises a perspective that keeping networks/systems separate post M&A is a more secure approach.
