⛑Final Rule Clarifies Employee Representation During OSHA Inspections 🔎The US Department of Labor (OSHA) today published a final rule clarifying the rights of employees to authorize a representative to accompany an OSHA compliance officer during an inspection of their workplace. Practically speaking, it gives the average worker more powerful representation during the inspection process regarding workplace conditions. The Occupational Safety and Health Act gives both the employer and employees the right to authorize a representative to accompany OSHA officials during a workplace inspection. ⚖️The final rule clarifies that, consistent with the OSH Act, workers may authorize another employee to serve as their representative or select a non-employee. OSHA published its final Worker Walkaround Representative Designation Process rule on March 29. The rule permits the employer to authorize non-employee representatives to accompany OSHA inspectors during workplace inspections. The representative must be reasonably necessary (i.e., needed for the inspection) based on the representative’s experience, knowledge, or skills. The new regulation is, in part, a response to a 2017 court ruling that OSHA’s current rule, 29 CFR 1903.8(c), only allowed employees to serve as representatives.
