🎉 Big win for privacy! The Federal Trade Commission has taken bold action against Mobilewalla, a data broker accused of unlawfully collecting and selling sensitive location data. Mobilewalla was found tracking individuals at deeply personal places—like pregnancy centers, places of worship, and political events—without consent, then selling that data to third parties. The FTC stepped in, marking their first-ever case addressing misuse of data from real-time bidding exchanges. As part of the settlement, Mobilewalla is now banned from collecting or selling data from sensitive locations and must delete previously collected sensitive data. This decisive move not only safeguards consumer privacy but also addresses potential national security risks. Kudos to FTC Chair Lina Khan and her team for sending a clear message to data brokers: consumer privacy is not for sale.

$5.6 Million in Refunds Sent to Ring Customers, Settling Unauthorized Access and Privacy Violations: America's Federal Trade Commission "is sending more than $5.6 million in refunds to consumers," reports the Associated Press, "as part of a settlement with Amazon-owned Ring, which was charged with failing to protect private video footage from outside access." In a 2023 complaint, the FTC accused the doorbell camera and home security provider of allowing its employees and contractors to access customers' private videos. Ring allegedly used such footage to train algorithms without consent, among other purposes. Ring was also charged with failing to implement key security protections, which enabled hackers to take control of customers' accounts, cameras and videos. This led to "egregious violations of users' privacy," the FTC noted. The resulting settlement required Ring to delete content that was found to be unlawfully obtained, establish stronger security protections and pay a hefty fine. The FTC says that it's now using much of that money to refund eligible Ring customers. According to their announcement Tuesday, the FTC is now sending 117,044 PayPal payments to affected consumers... The Office of the Australian Information Commissioner (OAIC) has issued a significant ruling, finding that Bunnings breached privacy laws by using facial recognition technology across 62 stores without obtaining proper consent from customers. The OAIC has ordered the destruction of unlawfully collected biometric data, sending a strong message about compliance with Australian Privacy Principle 11. Kmart, also using similar technology, may face similar outcomes based on this precedent. This case, stemming from a two-year OAIC investigation, underscores the critical importance of aligning security practices with robust privacy and governance frameworks. For businesses leveraging advanced technologies like facial recognition, it’s not just about innovation—it’s about doing it responsibly. At BAMSS, we advocate for ethical security practices that protect not just physical assets but also the privacy of individuals. Compliance with privacy laws and proper governance measures, including consent management and transparent policies, is non-negotiable in today’s regulatory environment. This ruling serves as a reminder for all industries to prioritise privacy in their security strategies, ensuring that technology enhances trust rather than erodes it.
