Do you ask your employees to opt out of the Working Time Directive? If so do you include it in the contract? It is recommended that you provide a separate form so that the employee has a clear understanding of what they are being asked to do and if they change their mind what they need to do. RIGHT TO DISCONNECT | Did you know that all Modern Awards are being changed to include a right to disconnect outside of working hours? The Fair Work Commission is set to publish a draft clause by mid next month, with the final clause due to be inserted into all Modern Awards by 26 August 2024. The changes will start in late August 2024 for large employers (and in late August 2025 for small business employers). The Commission is also required to make written guidelines about how the right to disconnect will operate - which will hopefully help employers to navigate the new right. There is currently debate taking place about how the term will coincide with other Modern Award clauses which contemplate out of hours contact with employees.
