➡️ Here's what you need to know before renewing or extending your TN visa: 1️⃣ Ongoing Eligibility: You must continue to work in a skilled occupation under the TLCAN and maintain an employment relationship with the same employer or a new qualifying one. 2️⃣Updated documentation: Ensure you have an updated letter of employment and evidence of ongoing compliance with TN visa eligibility requirements. 3️⃣ Enough time: Begin the process of renewal or extension several months before your current visa expires to avoid interruptions in your legal status. 4️⃣ Compliance with immigration regulations: Respect the terms of your TN visa and don't work for an unauthorised employer in your specific field. 5️⃣Legal advice: Consider seeking the help of an immigration attorney specializing in TN visas to ensure you follow the process correctly and meet legal requirements. If you’re applying for the EB-3 visa, it’s important to understand who is responsible for covering each fee. Typically, the employer pays for immigration-related costs, including the I-140 form, labor certification (PERM), job advertising, and the attorney managing the employment aspect. Fees related to medical exams, consular processing (DS-260 form), adjustment of status (I-485 form), or dependent visas are usually the applicant's responsibility. These arrangements can vary, so it’s essential to review your agreement with the employer to avoid unexpected expenses. World politics and news have prompted many people holding non immigrant visas in the United States to inquire about different options for permanent residency. Below are some minimum requirements for the EB2 National Interest Waiver. Eligibility for an EB-2 NIW An official academic record with proof of a degree, diploma, certificate, or similar award from an institution of higher education. Letters documenting 10 or more years of full-time experience. A license/certification to practice the profession. Is it difficult to get an EB-2 NIW? You may question your chances of success given the high standards. One of the criteria is that your work must be in the national interest of the United States. Securing an EB-2 NIW may be easier than you think—over 80% of applicants get approved every year. Can I apply for EB-2 NIW myself? A foreign national can file their own EB-2 NIW petition and file the I-140 form on their own behalf, without the involvement of either an employer or a labor certification. I often refer to this option as the Freedom Card as for the benefit of self sponsorship. More options to come........

What is considered an advanced degree for EB-2 visa purposes? An advanced degree is defined as any degree above a bachelor's, such as a master's, doctorate, or professional degree (e.g., MD, JD). This visa category provides a pathway to permanent residency and allows for family members to join the principal visa holder. I have an approved I-140 (Or I-130), so I don't qualify for a TN Visa. What now! There is a common misconception that an approved I-130 or I-140 prevents you from renewing or getting a TN visa. This is FALSE. We have helped countless clients with approved I-130s and I-140s with varying fact patterns still obtain TN visas and later transition to U.S. permanent residence. Three points to keep in mind: 1) TN Visa with Approved I-130 or I-140: As the beneficiary of an approved I-130 or I-140, you are NOT automatically blocked from TN visa eligibility. It is all about your intent upon entry to the United States. Think temporary! 2) Spouse’s Petition: Even if your spouse has an approved immigrant visa petition, as long as your intent is temporary, you can still obtain a TN Visa. 3) Adjustment of Status/Consular Processing: Once you file for adjustment of status or commence consular processing, your intent changes from temporary to permanent. Make sure you time this stage of the immigration process along with your TN visa validity dates. In short, while I-130 or I-140 approvals add another layer of complexity, they don't necessarily bar your eligibility for a TN visa.
