World politics and news have prompted many people holding non immigrant visas in the United States to inquire about different options for permanent residency. Below are some minimum requirements for the EB2 National Interest Waiver. Eligibility for an EB-2 NIW An official academic record with proof of a degree, diploma, certificate, or similar award from an institution of higher education. Letters documenting 10 or more years of full-time experience. A license/certification to practice the profession. Is it difficult to get an EB-2 NIW? You may question your chances of success given the high standards. One of the criteria is that your work must be in the national interest of the United States. Securing an EB-2 NIW may be easier than you think—over 80% of applicants get approved every year. Can I apply for EB-2 NIW myself? A foreign national can file their own EB-2 NIW petition and file the I-140 form on their own behalf, without the involvement of either an employer or a labor certification. I often refer to this option as the Freedom Card as for the benefit of self sponsorship. More options to come........

Today, we talk a bit about EB-2 Visas. Let's dive in. EB-2 visas are designed for professionals holding advanced degrees (masters or higher) or individuals with exceptional abilities in their field. Now, unlike EB-1 visas, applicants for EB2 visas must obtain a labor certification from the Department of Labor, unless they qualify for a national interest waiver based on their significant contributions to their field. Also, unlike the EB1 category, EB2 visas often face backlog issues, especially for certain countries with high demand for visas, leading to longer waiting periods for applicants. EB2 visas are known to typically cater to individuals with advanced degrees or exceptional abilities who don't necessarily meet the criteria for the EB1 category. The Employment-Based Second Preference (EB-2) visa is an immigrant visa category for non-U.S. citizens with advanced degrees or exceptional abilities who are seeking permanent residency in the United States. Here are some things to know about obtaining a green card through the EB-2 category: Annual limit The number of EB-2 visas issued each year is capped at 28.6% of the worldwide employment-based visa limit. Sponsorship Usually, a U.S. employer must sponsor the applicant for an EB-2 visa. However, applicants may be able to self-petition if they qualify for the EB-2 National Interest Waiver (NIW). Fees There are several fees associated with the EB-2 visa application process, including the I-140 filing fee, I-485 filing fee, biometrics fee, and DS-260 filing fee if applying from abroad. Family If the I-140 petition is approved, the applicant's spouse and unmarried children under 21 are eligible to obtain their green cards as dependents.
