Launching a new brand without consulting with a lawyer 😳? Definitely a risk that will cost you 🥺 An entertainer retainer client of us launched a new brand & began selling tickets. He never consulted with me or anyone at the firm. The moment I got to hear about this was when a 7 days cease & desist letter ✉️ was served upon him. The firm swung in to see how we could handle the crisis as the show must go on. Bearing that in mind, first thing was to get a new name, search for availability at the trademarks registry & proceed to register it. Then, redesign the logo to go along with the new name. If there’s one thing I appreciate about that letter sent to our client was simply the fact that they learnt that you don’t just register your mark and leave it idle. You must also protect your mark from unauthorized users so it doesn’t mislead the public and thereby profiting the unauthorized users. I guess he & his team have learnt a lesson and trust me, it’s always impactful when these entertainers learn via their mistakes how to properly do business. They will be the ones educating their fellow entertainers on the importance of registering their brand names with the trademarks registry before launching a new brand. BrandNews: Are You Using Your Own Artwork As Your Logo? You are in control of your brand’s legal risk. 😯 Doing things on the cheap is a way of life for many startups. Sometimes being penny-wise is pound-foolish. 💸 My marketing friends can tell you all the many reasons an investment in them to create a logo is money well spent. Maybe one of them will write this post and link to it in the comments. In addition to the marketing reasons, there are legal reasons not to take your drawing and use it as your #logo. While you clearly own the image you drew from your imagination, that does NOT give you the right to use the image as a brand. They’re two different things. Under trademark law, the main question is whether your use of an image could confuse the public into believing there is a connection between your company and some other company. Your ownership of the drawing is irrelevant. The phrase “but I didn’t know” is the reason I started my firm. I heard this phrase so many times from small companies when I worked for big firms and represented the large companies. These small companies were taking chances by operating in unknown conditions. This risk was not necessary, and I want to show them the way to certainty. My mission is to inform, educate and represent small and mid-sized companies in the world of intellectual property, and specifically #brand rights. My purpose is to remove obstacles and reduce the friction that may prevent you from conducting business as you wish. Most of you probably shouldn’t hire me. But it’s not what you think. It’s not me. It’s you. Not in a bad way. In a very good way. Especially if you take the long view. You have a lot to build. And a lot to invest in. And you wouldn’t want to put the cart before the horse. And the horse is your IP attorney. Have you vetted your name with them? Registered with the USPTO? Do you own the trademarks and urls? There’s two ways to go here. You can hire me to work through it all for you, or you can do it yourself. And it’s really a matter of budget. Which is why most of you shouldn’t hire me. Notice I said most. Because it’s not appropriate use of your funds or time… yet. Here’s what is appropriate. Find an IP attorney. You need them for every step of the branding process. They are the final say in your brand defensibility. I’ll share with you my favorite firm, based out of California. The best of the best. It turns out this wasn’t just a new product—it was an entirely new business, and he asked about the cost of company registration. While it’s always great to guide entrepreneurs, it’s essential to get a few key steps right before launching a brand. Registering your company before publicizing it is one of the best moves you can make. Here’s why: It prevents “breakfast” over your Brand Name! Imagine putting your heart into building a brand, only to find someone else has already secured rights to the same name or logo. When you register your company, you protect your brand from being claimed by someone else. Steps to Get Started: 📌 Register Your Company: First things first, get your company registered with the Corporate Affairs Commission (CAC).
