Important for #dataprotection litigation: It has been debated whether Article 80.2 #GDPR prevents #privacy associations from initiating GDPR class actions for obtaining damages without a mandate of data subjects. Another question is whether national law may impose additional admissability requirements on such associations than those mentioned in Article 80 GDPR. In a judgement of 13 November 2024 between the Dutch privacy association Stichting Data Bescherming Nederland and Amazon, the Rotterdam District Court announced that it will refer these premilinary questions to the EU Court of Justice.
