Conveniently, since "sometime in 2023" IMY no longer record the name of the Data Controller in their case management system. This is what I was told today in response to a freedom of information request. This means it is now impossible for IMY to be able to query whether or not an "information letter" is sent to a Data Controller more than once; to determine whether or not such letters are an effective motivator to encourage a Data Controller to comply with the law. Yet in my complaint against IMY, they are claiming these letters are effective....how do they know this when they have literally removed their own ability to measure their effectiveness? Important for #dataprotection litigation: It has been debated whether Article 80.2 #GDPR prevents #privacy associations from initiating GDPR class actions for obtaining damages without a mandate of data subjects. Another question is whether national law may impose additional admissability requirements on such associations than those mentioned in Article 80 GDPR. In a judgement of 13 November 2024 between the Dutch privacy association Stichting Data Bescherming Nederland and Amazon, the Rotterdam District Court announced that it will refer these premilinary questions to the EU Court of Justice.
