The kids are ready. But are we? As a collective, we have much to learn from them. I’ve worked on this guide for a while. However, watching kids get violently pepper sprayed at VCU yesterday enraged me enough to finish it. 🚨 Do you know protest aftercare tips? 🚨 Do you know how to neutralize tear gas? 🚨 Do you know how to assess a scene for safety? If you don’t, let’s learn together. The kids know how to organize. They’re prepared from years of school shooter drill. They know how to care for each other. Again, we have much to learn. Please excuse the dramatic musical background, but as always, I’m a sucker for Reagan quotes. And this post just gave me a choice one on something I’ve been thinking about lately: not as it pertains to protests, but as it pertains to enforcing laws writ large. Here’s the quote: “I’m sick and tired of the argument about whether some effort to enforce law and order is going to escalate anything at all.” Here are my own thoughts, namely that as long as we operate within the law in its enforcement, we are in the right; but once we step out of its bounds, we give everything up. My thoughts are mostly in the realm of international law. Some these days say that international laws are ineffective or bygone, that their defense is better served by acting as our adversaries do … employing realist ends, ways and means to scrap out some short term victories in places like the South China Sea. Never mind that in doing so we become as our adversaries, negating the ideals around which laws are established. These ideals include equal application of territorial seas and Exclusive Economic Zones for all coastal states, the sovereign rights of nations, and the human rights of individuals, among others. But to these people I ask: “Have you tried enforcing the law yet?” The answer in many cases is “no.” They’ll cite transparency initiatives, or diplomatic demarches. They’ll decry the malign actions of rule-breakers and others’ lack of response. They’ve tried “everything.” But have they gone out and made arrests? Seized assets? Issued fines? Have they done so consistently? Before throwing out the law one defends - in its “defense”- one must attempt its enforcement first, whether via national and/or international mechanisms. We are right to enforce the law - and to do so aggressively - within its bounds. This includes through use of realist means such as seizing assets, or maybe exploding vessels of violators up as the Indonesians do. But all under the auspices of rules and norms. Reagan is absolutely correct. Breaking his quote down to a couple points… First, on “escalating anything at all.” Reagan knew that managing escalation is only self-deterrence. It places undue limits on ourselves without affecting the adversary. Just as a criminal doesn’t give a darn about the law by way of leniency, our strategic adversaries don’t respect laws we don’t enforce. They are not influenced as we would hope by our goodwill, for they do not share the same vision - which runs counter to the laws we’ve established. They are hard-core realists, our ideals not appealing to them. Rightly, they see them as threats to what they hold dear: power. Which leads to the second point on “enforcing law and order.” Laws are created by people and nations. They must be enforced to honor them. To not enforce the law is to counter-act its legitimacy. It is to cede our greatest strength in ideals by confusing realist ways and means as a strategic end, thus displacing the rule-of-law.
