When I became Director of Digital Technology Policy at DCMS in 2021 the Digital Markets Bill was a top priority. I’m in a new role now but Royal Assent of the Bill is a moment to recognise the years of extraordinary dedication and hard work of my fantastic team is DCMS and now DSIT, alongside my colleagues in DBT that worked so hard at every single stage in the formation of this legislation. We could not have done it without the support of colleagues across the regulators or without the generous engagement from across the tech industry. It's incredible how swiftly the year is moving, and here we are already in May - I am thankful for life and for another opportunity to reset and refresh our financial strategies. This is a pivotal month to elevate our understanding of financial literacy and the crucial role of consumer protection. I am encouraging you all to deepen your knowledge and ensure you’re not only managing your finances well but also safeguarding your rights in the financial marketplace. But maybe your saying “Eman why is this important?” And put simply consumer protection is all about the laws and safeguards that ensure you, as a consumer, are treated fairly by businesses and not misled by advertisements, contracts, or sales tactics. It's about making the marketplace fair and safe for everyone. Let me give you a hypothetical example, suppose you are buying a new smartphone and the advertisement promises a significant discount on your next bill if you switch to a certain network. However, after switching, you find out the discount only applies under specific conditions that weren't clearly stated in the ad. Consumer protection laws help ensure that all promotional terms are clearly disclosed, protecting you from such misleading claims. Knowing your rights as a consumer is crucial. It enables you to navigate the market more effectively, understand the fine print of agreements, and avoid falling prey to deceptive practices. The start of May is a good time for us to reassess and reinforce our financial practices, ensuring that our engagements are secure and our decisions well-informed. 📣 #Temu As anticipated yesterday by the press, today the European Commission has opened formal proceedings to assess whether Temu may have breached the #DigitalServicesAct in areas linked to the sale of illegal products, the potentially addictive design of the service, the systems used to recommend purchases to users, as well as data access for researchers. More specifically, the investigation will focus on: ➡️ The systems Temu has in place to limit the sale of non-compliant products in the EU. Among others, it concerns systems designed to limit the reappearance of previously suspended rogue traders, known to have been selling non-compliant products in the past, as well as systems to limit the reappearance of non-compliant goods. ➡️ The risks linked to the addictive design of the service, including game-like reward programmes, and the systems Temu has in place to mitigate the risks stemming from addictive design. ➡️ The compliance with the DSA obligations linked to how Temu recommends content and products to users. This includes the requirement to disclose the main parameters used in Temu's recommender systems and to provide users with at least one easily accessible option that is not based on profiling. ➡️ The compliance with the DSA obligation to give researchers access to Temu's publicly accessible data. Temu would face liability under the #DSA if the Commission's suspicions were proven correct. The Commission will now carry out an in-depth investigation as a matter of priority. Ecommerce Europe and its national association members have been following this process very closely, in line with the campaign that was jointly launched in June 2024 for a level playing field and an effective enforcement of EU rules towards all #ecommerce players active in the EU, no matter where they are based.
