Really looking forward to contributing to this Social Justice, Private Law and Europe workshop this week! Some preliminary thoughts from me here on the reconceptualisation of business freedoms through a fundamental social rights lens.
We are starting the week leading up to the workshop on Social Justice, Private Law and Europe with three more excellent contributions. Our first contribution is written by Niall O’Connor and gives a reconceptualisation of business freedoms as encapsulating social rights through the lens of fundamental rights: Reconceptualising the Social https://lnkd.in/ehBf9c-j The second contribution by Camilla Crea and Marta Infantino looks at how digital vulnerability can be taken seriously in private law as a tool for social justice: https://lnkd.in/eckxp3jN Our third contribution comes from Thomas Wilhelmsson who writes on the temporal elements of social justice and private law fairness between generations: https://lnkd.in/eu85ypmE

🌍Promoting Peace, Justice, and Strong Institutions 🕊️. In our most recent group discussion, we addressed the critical issue of fostering openness and accountability in government, as well as strengthening institutions to protect human rights and the rule of law. Our discussion focused on essential topics such as open government data, citizen involvement, independent scrutiny, and using technology to foster trust and accountability. We also emphasised the importance of independent judiciaries, legislative reforms, and civic education in promoting social justice and equality. Special thanks to our teacher Sahiba Kalyan for guiding us through these critical discussions. 🙌 Watch the video to learn how strengthening these foundations can result in a more just and stable future! 🎥💡 #peaceandjustice #transparency #stronginstitutions #government #humanrights #accountability #ruleoflaw

Most of us studied law because we believe that it is a tool to effect social justice and change in the society. In a society that is filled with class structure. There would always be the marginalized. Therefore the lawyer is a professional trained in the act of using the instrumentality of the law to ensure that a form of equality is achieved. Over the years I have been privileged to work closely with immigrants and non-immigrant . They all seem to have a single story. Their story expresses hope in the country they find themselves. Now the lawyer is the one who helps to reinforce this hope; by allaying their fears and concerns and ensuring that proper documentation is done. I am here to say as professionals generally, our ultimate job is to establish faith and hope in the system by offering services with empathy and professionalism. #immigrationlaw #WashingtonDC #law #legalrepresentation #humanrights

The Law Council of Australia is concerned about the state of youth justice across the nation. Generally, the Law Council observes that children’s human rights need to be better respected and protected in the justice system. In the context of youth justice, the introduction of human rights legislation in all jurisdictions that do not currently have it (including the Commonwealth) would facilitate change in the culture and norms underpinning the youth justice policy. Specifically, it would assist to ensure that the best interests of the child are a primary consideration in driving reform. Human rights: Food for a failing thought ‘HR and the justice system’ HRR 749 AT THIS PIVOTAL JUNCTURE, UNITING CLAIM HOLDERS, ACADEMICS AND THE BROADER PUBLIC IS NOT JUST AN INVITATION BUT AN IMPERATIVE. [This Reader is about how the right to justice is obstructed for the have-nots and what claim holders ought to do about it]. Traducir/traduire los/les Readers; usar/utiliser deepl.com Expanding equal access to justice is one of the most powerful ways to combat the pull of populism and autocracy Enforcing accountability persists* as an obstacle in many national courts. Economic actors can and do prevent the initiation of legal claims or can delay the litigation process through legal procedural maneuvers, thus securing de-facto impunity. As a result, advocates of accountability (human rights activists) must come up with legal mobilization strategies so as to guarantee that judicial investigations are not impeded or shelved indefinitely. [*: The history of demanding accountability for human rights violations shows a string of difficulties, is perplexing and has resulted in close to no positive results. Is neoliberalism and the Western cultural chauvinism what explains why there is no international intervention in, for instance, urgent humanitarian catastrophes caused by current violence? How and by whom has the HR project failed to stop the atrocities? A clear conclusion follows: Regrettably, accountability takes decades and only partially arrives]. We must frankly recognize that justice systems have been failing too many people for too long. Not everyone can truly trust that their human rights are protected by the justice system. Striking data quantify the justice gap and the especially heavy price it exacts on those rendered poor and marginalized.
