Policymakers and regulators have enacted laws and regulations in response to growing concerns about consumer privacy. Two key insights emerge:  - Data exchanges between consumers and firms generate benefits and costs for both.  - Regulations limiting collection and use of data to protect consumer privacy involve tradeoffs between these costs and benefits, with consequences for competition and innovation. In an article for the American Bar Association Antitrust Law Section, Cornerstone Research’s Vildan Altuglu, Conor Foley, and lorenzo michelozzi review the economic literature on the effects of data privacy regulation on consumers and firms.

Oregon is ramping up public awareness of its Consumer Privacy Act, releasing new survey data showing 80% of residents prioritize privacy. While the law shares many common requirements with other state privacy laws, one standout obligation is its mandate for businesses to provide consumers with lists of third parties that have purchased their data. This transparency requirement goes beyond typical disclosure obligations. Businesses operating in Oregon need to track and be ready to report on their data selling practices in detail - not just what data they collect, but specifically who they've sold it to.

As the ninth state in the US to introduce a privacy law, Florida’s Digital Bill of Rights (FDBR) will come into effect on July 1, 2024. This bill specifically addresses tech giants and large-scale advertising companies, mandating stringent consent and data protection standards. The Florida Digital Bill of Rights consumer data protection provisions are also effective today. While not always seen by many as a truly “comprehensive” privacy law, Florida consumers will obtain new privacy rights and protections.
