DCG’s Litigation team is pleased to report that we received a significant jury verdict in favor of our client, TAKTL, a Pittsburgh-based manufacturer of Architectural Ultra High Performance Concrete (A|UHPC®) Facade Panels & Elements. The jury found that both defendants committed multiple material breaches of both contracts with our client. We have represented TAKTL since 2019 in its efforts to collect amounts owed by two contractors, and defend against significant counterclaims, related to the construction of two adjacent hospital buildings in St. Louis, Missouri. This trial involved an advisory jury, so entering final judgment is still in the hands of the court. Brian Maloney and Chad Wissinger led the core trial team, assisted by Julie Mueller and Connor Sease. Joanne Chojecki coordinated extensive paralegal support, with help from Gabrielle Kossuth and Nicole Pozzuto. Kevin Harkins, Lexie Thurston, Jonathan Sion, and Gregory Thomas also contributed significantly. The verdict is a meaningful positive outcome for our client, who is very happy with the result.

In a recent client alert, Robert Cottington and Abbie Britton discuss the Federal District Court for the Eastern District of Texas striking down the recent 2024 Department of Labor rule, which changed the salary threshold for exempt employees under the Fair Labor Standards Act (FLSA). The 2024 Final Rule temporarily increased the salary threshold for executive, administrative, and professional employees to qualify for exempt status in July and was set to increase again effective January 1, 2025.
