Absolutely the case that we need better #whistleblower protections for AI employees. But it’s not quite fair to say that there’s no existing applicable protections. AI employees at publicly traded companies have the SEC whistleblower rules. AI employees working on government contracts (an increasing percentage!) have the False Claims Act. AI employees generally have OSHA and SOX and a variety of other protections that may apply, depending on the circumstances. Tech companies always love to hold themselves apart and pretend like the old rules don’t apply. That’s a mistake. In an ideal world, AI companies would see this as an opportunity to create not only cutting edge technologies but also cutting edge HR policies. There’s absolutely no reason that this idea is, sadly, treated as laughable. You cannot create the future without well-respected, listened-to employees alert to all risks and ready to fix any problems that arise.
OpenAI staff are calling for better whistleblower protections in the AI industry. In regulated industries, like finance, whistleblowers enjoy U.S. government protection for reporting various violations of the law, and can even expect a cut of some successful fines. But because there are no specific laws around advanced AI development, whistleblowers in the AI industry have no such protections, and can be exposed to legal jeopardy themselves for breaking non-disclosure or non-disparagement agreements. “Preexisting whistleblower protections don’t apply here because this industry is not really regulated, so there are no rules about a lot of the potentially dangerous stuff that companies could be doing,” one former OpenAI researcher tells me and Will Henshall for our latest piece: https://lnkd.in/e4iAuHQ2

I’d missed this in my overview of US AI regulations yesterday. The Colorado AI Act, effective February 1, 2026, establishes consumer protection standards for AI system interactions, mostly in high-risk applications. To protect consumers, the Act requires developers and deployers to disclose when AI is involved in interactions, except in situations where it is self-evident. High-risk AI systems are defined as those influencing fields such as education, employment, and healthcare. The Colorado Attorney General will handle enforcement, categorizing violations as deceptive trade practices. Certain AI systems fall outside the high-risk category as defined by the Act. For example, anti-fraud systems (without facial recognition), anti-virus software, cybersecurity tools, AI-enabled video games, spam and robocall filters, and natural language applications used for information or referrals are excluded, as long as they follow policies preventing discriminatory content. Additionally, systems that perform specific tasks without altering human decision-making do not require the same oversight under this legislation. High-risk AI systems must meet annual review standards to assess their potential impacts, particularly concerning algorithmic discrimination. This includes completing an impact assessment each year, as well as reassessing the system within 90 days of any significant change that may introduce additional risks of bias. The Act requires deployers to evaluate their systems regularly, reducing risks related to discrimination and keeping consumer protections in place. To maintain transparency, deployers of high-risk AI systems are required to provide and periodically update a statement on their websites, addressing these three points: 1️⃣The types of high-risk AI systems in use. 2️⃣How the deployer manages foreseeable risks of algorithmic discrimination and proactively works to prevent bias. 3️⃣The sources, nature, and purpose of data collected in connection with the AI system. The Act also offers defenses for developers and deployers who address and mitigate risks actively. Rebuttable presumptions allow deployers to assume certain facts as accurate unless challenged. Affirmative defenses protect developers if they can demonstrate compliance with an established risk management framework. For this, recognized standards include the NIST AI Risk Management Framework, the ISO 42001 AI Standard, or an equivalent, providing compliance protections against potential violations. I expect we’ll see more of these State-level AI laws throughout 2025, perpetuating the same challenges businesses have with US-based privacy laws. #AI #law #colorado

Colorado has made a significant leap in AI regulation by becoming the first state in the U.S. to enact comprehensive artificial intelligence legislation with the Colorado AI Act (SB 24-205). This landmark law, effective February 1, 2026, targets developers and deployers of high-risk AI systems, imposing strict obligations to ensure transparency and prevent algorithmic discrimination. The Act defines high-risk AI systems as those making consequential decisions affecting critical areas such as education, employment, financial services, government services, healthcare, housing, insurance, and legal services. Exclusions are made for systems performing narrow procedural tasks or detecting patterns without influencing human assessment. Key obligations for developers include providing comprehensive documentation and risk management information to deployers, reporting algorithmic discrimination risks to the Colorado Attorney General, and ensuring public transparency about their AI systems. Open AI’s policies and practices appear to cast a chilling effect on whistleblowers’ right to speak up and receive due compensation for their protected disclosures..... Open AI required employees get prior consent from the company if they wanted to disclose information to federal regulators, adding that Open AI did not create exemptions in the employee non-disparagement clauses for disclosing securities violations to the SEC.... This practice removes transparency and calls in to questions the ethical nature of the work done by AI companies either now or in the future. We heard of Sony and Universal talking AI to court for copyright infringement over song generators Suno and Udio.....
