*** TRUCKING INDUSTRY: REMINDER AS OF NOVEMBER 18th, 2024*** New Federal Motor Carrier Safety Administration Drug and Alcohol Clearinghouse Regulations The Federal Motor Carrier Safety Administration (FMCSA) is set to launch the Drug and Alcohol Clearinghouse (DACH) on November 18, 2024. This new regulation will significantly impact commercial drivers and the trucking industry. The primary issues include: Driver Status: Drivers with a “prohibited” status in the DACH will lose or be denied their commercial driver’s license (CDL) or commercial learner’s permit (CLP). This can lead to a shortage of qualified drivers, disrupting operations and increasing costs for trucking companies. Return-to-Duty Process: Drivers with a “prohibited” status must complete the return-to-duty (RTD) process to regain eligibility for a CDL or CLP. This process can be time-consuming and costly, affecting both drivers and employers. State Driver Licensing Agencies (SDLAs): SDLAs are required to query the DACH before issuing, renewing, upgrading, or transferring CDLs. They must also review a driver’s information when notified by FMCSA of a status change and remove commercial driving privileges for drivers in a “prohibited” status. This adds administrative burdens and potential delays in licensing processes. By staying in compliance with this new regulation trucking companies can achieve several key benefits: Reduced Operational Disruptions: Proactive compliance management helps prevent sudden driver shortages, ensuring a steady workforce and minimizing disruptions to operations. Cost Savings: Efficiently navigating the RTD process and maintaining driver eligibility can save companies significant costs associated with hiring and training new drivers. Enhanced Safety and Reputation: Ensuring that all drivers are compliant with FMCSA regulations enhances overall safety on the roads. This not only protects the company from potential liabilities but also boosts its reputation as a responsible and dependable operator. In conclusion, the new FMCSA Drug and Alcohol Clearinghouse regulations present challenges, but with the right support and strategies, trucking companies can get through these changes effectively. No wonder people don't trust the insurance industry. How can they when they don't get all the facts! What I want to know is if this person had flood insurance ⁉ It's easy to make the insurance company the villain when a total loss isn't paid... That's what happened in Hurricane Harvey that hit Houston in 2017. Damage due to the actual hurricane winds were paid by homeowners insurance companies, but wind was not what caused most of the damage. Over 50 inches of rain dropped in 4 days, which caused record flooding that no one ever thought possible. The end result? Less than 10% of homeowners had flood insurance, so over 90% of the homeowners insurance claims were denied because homeowners insurance does not cover flooding. Was the insurance company being a greedy bad actor for not paying those 90% of denied flood claims? Allow me to answer that question with another question. If you do all of the regular maintenance on your vehicle, except get an oil change, is it the mechanic's fault when your engine stops running? To drive the point home, would you expect the mechanic to pay you for a new car for not changing your oil? I'm not saying the Hurricane Harvey victims are to blame. Most of them were not in a 100-year flood plain and had no idea they were at risk of ever being flooded...my dad included. But that doesn't make the insurance company the bad guys. That's where programs like FEMA and state level agencies should step in to help with the economic recovery. Lastly, if you don't think those programs do enough to help in natural disasters, then you should vote to replace the congressmembers and state legislatures that vote against natural disaster aid.

A recent encounter during a storm hitting the Gulf coast in Texas shed light on the significance of qualified professionals and localized support in managing claims effectively. The initial interactions highlighted challenges such as language barriers and privacy concerns, emphasizing the need for experienced and licensed adjusters to handle claims.
