Michigan has significantly expanded its R&D Tax Credit, incentivizing in-state research activity. Bills HB 5100-5101 were passed by the House this week, and the details are exciting: 🧑🏻‍💼 Who? Corporate and pass-through entities incurring qualified R&D expenses in MI 🔬 What? Activities that meet the federal definition of R&D 📅 When? Tentative claims must be submitted by 4.1.2026 for TY 2025 💵 How Much? o  Large Taxpayers (250+ Employees): Up to 3% on base expenses and 10% on excess expenses (capped at $2M annually) o  Smaller Taxpayers:  Up to 3% on base expenses and 15% on excess expenses (capped at $250K annually) 🎓 University Bonus? o  Additional 5% Credit for research conducted with Michigan research universities (up to $200K annually) This is a huge step up from the previous 1.9% Credit – what a win for MI! 📣 Attention Michigan Business Owners 📣 The Michigan Supreme Court’s decision on July 31, 2024, to reinstate the Earned Sick Time Act (ESTA) and Improved Workforce Opportunity Wage Act (IWOWA) will take effect in February 2025. Here’s what you need to know: 1️⃣ Earned Sick Time Act (ESTA) Compliance by February 21, 2025: All Michigan employers, except the U.S. government, are covered. All employees are now eligible for sick time, not just specific categories. Sick time must accrue at a rate of 1 hour for every 30 hours worked. Employers with 10+ employees must allow up to 72 hours of paid sick time per year. Employers with fewer than 10 employees must provide up to 40 hours of paid sick time and 32 hours of unpaid sick time annually. Unused earned sick time can be carried over without restriction, and up to 72 hours of sick time can be used per year. 2️⃣ Improved Workforce Opportunity Wage Act (IWOWA) Changes Effective February 21, 2025: Minimum wage will increase to $10.00 plus an inflation adjustment, to be determined. Future wage increases will be based on inflation. The "tip credit" for tipped employees will be phased out by February 21, 2029. Employees will have expanded rights for overtime compensation, including options for “comp time.” Ensure your business is prepared for these changes!
