2024 Federal Budget – Trust Capital Gains On Monday and Tuesday, I discussed the changes to the capital gains inclusion rate for individuals and corporations proposed in the April 16, 2024 Federal Budget. Today, I will discuss the impact of the proposed capital gains inclusion rate changes to Trusts. The federal budget proposes to increase the capital gains inclusion rate from one-half to two-thirds for trusts on all capital gains realized on or after June 25, 2024. Importantly, unlike individuals, trusts (and corporations) will not be entitled to the lower fifty percent capital gains inclusion rate on the first $250,000 of capital gains. The increase in the capital gains inclusion rate may impact your trust planning in a number of ways, including: · Trustees of trusts that retain capital gains in the trust (as opposed to flowing it out to the beneficiaries each year), will have to decide if the trust is going to realize capital gains prior to June 25, 2024 to take advantage of the lower fifty percent capital gains inclusion rate. · Similarly, trusts that annually trigger capital gains in the trust, but distribute out the capital gains to the beneficiaries, will need to consider whether they should accelerate the disposition of the capital property prior to June 25, 2024, so that the trust beneficiaries will be allocated the capital gain in the pre-June 25th period on their 2024 T3 (assuming the 2024 T3 will provide for this). · While many trusts provide for the possibility of the distribution of capital tax-free to the beneficiaries on the 21st anniversary of the trust, some trusts cannot or do not distribute the property and thus have a deemed disposition of the trust capital property at fair market value on the 21st anniversary of the trust. If the 21st anniversary of the trust falls in 2024, but after June 24, 2024, the trustees need to consider whether they should sell the capital property prior to June 25th to utilize the lower fifty percent capital gains inclusion rate if the trust is not going to distribute the trust property.   It will be prudent to set-up a meeting with your accountant to review these changes and how they affect any trusts you are involved with.
